QUASI-JUDICIAL LAND USE DECISION

(Public Land Tree Removal -Olepha Drive)

The Scappoose Planning Commission has scheduled an appeal hearing to review the administrative approval of an application for a Public Land Tree Removal permit submitted by Stephanie Siegman/Chuck Lohman for the removal of two street trees in the Olepha Drive public right-of-way. The site is located at 33282 Scappoose Vernonia Hwy, on property described as Columbia County Assessor Map No. 3201-CC-03600. The stated reasons for the appeal include “Questionability of the Arborist’s assessment, and the stated reason for removal is believed to be different than the actual reason”.

The meeting is scheduled for Thursday, January 14, 2016, at 7:00 p.m. in the Council Chambers of the Scappoose City Hall located at 33568 East Columbia Avenue. Persons are hereby invited to attend the Scappoose City Council hearing. In accordance with Section 17.162.300(B) of the Scappoose Municipal Code, the appeal hearing shall be confined to the prior record of the proceedings. Furthermore, the appeal hearing shall be limited to the grounds relied upon in the notice of appeal. The Planning Commission shall affirm, reverse or modify the decision which is the subject of the appeal.

The Planning Commission’s decision on the above appeal item must be based on findings that a specific set of criteria have been or have not been met, particularly applicable sections of Title 17 (Land Use and Development) of the Scappoose Municipal Code, with particular emphasis on Chapters 17.140 (Public Land Tree Removal); and 17.162 (Procedures for Decision Making–Quasi-Judicial).
