TRUSTEE’S NOTICE OF SALE
Reference is made to that certain trust deed made by RAYMOND J. CARROLL, as grantor, to OREGON TITLE INSURANCE COMPANY, as trustee, in favor of ANGELA J. MARTIN BUCK, as beneficiary, dated March 10, 1997, recorded March 11, 1997, as Instrument No. 97034904, in the Official Records of Multnomah County, State of Oregon (Trust Deed), covering the following described real property situated in the above mentioned County and State:
Real property in the County of Multnomah, State of Oregon, described as follows:
THE SOUTH ONE-HALF OF LOT 25 AND THE NORTH 3 FEET OF LOT 26, ACCORDING TO THE DULY FILED PLAT OF MIDLAND ACRE TRACTS, IN THE CITY OF PORTLAND, FILED JANUARY 7, 1908, IN PLAT BOOK 414, PAGE 20, RECORDS OF THE COUNTY OF MULTNOMAH AND STATE OF OREGON.
ALSO THE NARROW TRIANGULAR STRIP OF LAND AT THE SOUTH EDGE OF THE NORTH ONE-HALF OF LOT 25, MIDLAND ACRE TRACTS, BEGINNING AT THE SOUTHWEST CORNER OF THE NORTH ONE-HALF OF LOT 25; THENCE NORTHERLY 3 FEET ALONG THE EASTERLY SIDE OF S.E. 111TH AVENUE; THENCE EASTERLY 234.85 FEET TO THE SOUTHWEST CORNER OF THE NORTH ONE-HALF OF LOT 25; THENCE WESTERLY 235 FEET TO THE PLACE OF BEGINNING.

On October 6, 1997, ANGELA J. MARTIN BUCK assigned her beneficial interest in the Trust Deed to TITLE INSURANCE COMPANY OF OREGON, an Oregon corporation dba FIRST AMERICAN TITLE INSURANCE COMPANY OF OREGON, by assignment recorded on October 7, 1997, as Instrument No. 97154246, and was subsequently modified by that Loan Modification Agreement dated November 26, 2011, recorded as Instrument No. 2011-140850, recorded on December 12, 2011 in the Real Property Records said County and State.
The current beneficiary and the successor trustee have elected to foreclose the Trust Deed by advertisement and sale to satisfy the obligations that the Trust Deed secures and a Notice of Default has been recorded pursuant to Oregon Revised Statutes 86.752. The defaults for which the foreclosure is made are:
Unpaid principal and interest as of December 4, 2015 in the total amount of $127,818.18, with interest continuing to accrue at the rate of five percent (5%) per annum, from December 4, 2015 until paid; and previously deferred property taxes now due and payable in the amount of $15,905.16 as of December 4, 2015, with per diem of $2.52.
Based upon the default, the beneficiary has declared all sums owing on the obligation that the Trust Deed secures immediately due and payable, those sums being the following:
Principal and interest in the amount of $127,818.18, with interest accruing at the rate of five percent (5%) per annum, from December 4, 2015 until paid; previously deferred property taxes now due and payable in the amount of $15,905.16 as of December 4, 2015, with per diem of $2.52; attorney’s fees, trustee’s fees, together with any other sums due or that may become due under the Note or by reason of this foreclosure and any further advances made by Beneficiary as allowed by the Note and Trust Deed.
WHEREFORE, the undersigned trustee will on Monday, May 2, 2016, at 1:00 P.M., in accord with the standard of time established by ORS 187.110, at the Front Steps of the Multnomah County Courthouse, at 1021 SW 4th Ave, Portland, OR 97204, sell at public auction to the highest bidder for cash the interest in the Property which the grantor has to satisfy the obligations secured by the Trust Deed and the expenses of sale, including the compensation of the trustee and the trustee’s attorneys. The grantor, the grantor’s successor in interest to all or any part of the Property, any beneficiary under a subordinate trust deed, or any person having a subordinate lien or encumbrance of record on the Property, have the right under ORS 86.778 to have this foreclosure proceeding dismissed and the Trust Deed reinstated by (1) payment of the entire amount then due, other than that portion that would not then be due had no default occurred, together with all costs and expenses actually incurred in enforcing the obligation and Trust Deed, including trustee’s fees and attorney fees as allowed by ORS 86.729; with payment to be made at any time that is not later than five days before the date last set for the sale, and (2) by curing any other default described herein.
In construing this notice, the singular includes the plural, the word “grantor” includes any successor in interest to the grantor as well as any other person owing an obligation, the performance of which is secured by the Trust Deed, and the words “trustee” and “beneficiary” include their respective successors in interest, if any.
