Water Right Transfer T-12160
T-12160 filed by the Oregon Department of Fish and Wildlife (ODFW), proposes an additional point of diversion under Certificates 53427 and 82966. Certificate 53427 allows the use of 45.0 cfs and Certificate 82966 allows the use of 5.0 cfs, both from the Clackamas River in Sec. 19, T3S, R4E, WM for fish hatchery/fish culture use in Sec. 19, T3S, R4E, WM. The applicant proposes an additional point of diversion in Sec. 20, T3S, R4E, WM. The Water Resources Department proposes to deny the transfer, based on the requirements of ORS Chapter 540 and OAR 690-380-5000 due to injury of Instream Water Right Certificate 59491. The Department is seeking a recommendation from the ODFW to consent to the injury under OAR 690-380-5050. Transfer Application T-12160 will be denied unless ODFW recommends consent to injury of the instream water right because T-12160 would result in a net benefit to the resource, and no protests are filed.
