NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN, that on October 3, 2016 the City Council of the City of North Plains will conduct a public hearing on the Planning Commission’s recommendation on File No.16-085 to update Chapter 16.065 (Floodplain Overlay) of its Zoning and Development Ordinance to reflect current FEMA regulations. The Planning Commission reviewed File No.16-085 and made a recommendation of adoption to the City Council. All comments can be submitted and an opportunity to speak before the Council will be provided at this second public hearing which will be held before City Council on October 3, 2016.
NOTICE IS HEREBY GIVEN, that on October 12, 2016 the Planning Commission of the City of North Plains will conduct three public hearings: (1) File No.16-087 the application for a 16-lot Subdivision located on tax map 1N301BC201, more commonly known as 32370 NW North Avenue, North Plains, OR. This application was submitted by Biggi Construction and property owners Mark and Lori Perkins; (2) File No.16-106 Municipal Code Chapter 16.170 Application Requirements and Review procedures will clarify verbiage for public notice requirements; (3) File No.16-107 Municipal Code Chapter 16.180 Conditional Use Permit will be reviewing the new marijuana business development standards code language.
Applicable sections of the zoning and development code include, but may not be limited to, the following: 16.00, 16.05, 16.15, 16.030, 16.40, 16.55, 16.135, 16.145, 16.150, 16.160, 16.170, and 16.175. Written comments will be received until 5:00 p.m. the day prior to the public hearing at City Hall, and then at the respective public meeting.
All evidence relied upon by the City to make this decision is in the public record. A copy of the application is available for review at North Plains City Hall during regular business hours or online at northplains.org. A copy of the City’s staff report and recommendation to the hearings body shall be available for review at no cost at least seven days before the hearing, and available online at www.northplains.org. The failure to address an issue with enough detail during the comment period or at the public meeting may preclude an appeal to the Land Use Board of Appeals or Appeals or Circuit Court on that issue. Only comments on the applicable criteria are considered relevant evidence. The hearing will be opened for presentation by the city and the applicant and then opened to the public. The hearing can be closed or continued at the discretion of the Planning Commission and City Council. If the hearing is closed, the Board has the right to extend the time for additional information to be submitted by the public or the applicant. After the comment period closes, the City shall issue a decision. The decision shall be mailed to the applicant and to anyone else who submitted written comments or who is otherwise legally entitled to notice.
City of North Plains City Council will hold a public hearing on
October 3, 2016 at 7:00 p.m. and the
City of North Plains Planning Commission will hold three public hearings on October 12, 2016 at 7:00 p.m.
Both meetings will be held at the North Plains Senior Center
