Pursuant to Section 50.45.4 of the Beaverton Development Code, public notice of the following development application is being provided:
VAR2014-0001 Fisher Building Sign Variance
The proposal is to vary from the provision found in Section 60.40.35.2 of the Beaverton Development Code which limits the number of projecting signs to one along a building face where abutting a street. The proposal seeks a total of eleven projecting signs along the SW Broadway Street frontage.  One sign is to identify the building name and would be 9.5 square feet in size.  Ten other signs are 4.5 square feet in size and are intended to identify businesses within the existing building.

The property and building is generally located on the south side of SW Broadway Street, east of SW Watson Avenue and west of SW Hall Boulevard. The property is addressed at 12448-12580 SW Broadway Street and is described as Tax Lots 5000 and 5001 on Washington County Tax Assessor’s Map 1S1-14BB.  The property is also located in the City Historic District and identified as the Fisher Building according to the City Historic Resource Inventory

To be addressed in the staff report and decision, written comments on the above development proposal are to be submitted no later than 4:00 p.m. on Wednesday, September 10, 2014.  Mailed written comments shall be sent to the Planning Division, Community Development Department, 12725 SW Millikan Way, Beaverton, OR 97005.  Written comments submitted in person shall be delivered to the Community Development Department, fourth Floor, 12725 SW Millikan Way, Beaverton.

The decision-making authority for the above application is the Planning Commission. Any decision on the above development application shall be based on the Variance approval criteria found in Section 40.90.15.1.C of the City Development Code.  The Planning Commission is scheduled to hold a public hearing on the above development application on Wednesday, September 24, 2014, beginning at 6:30 p.m. The meeting will be held in City Council Chambers, 12725 SW Millikan Way, Beaverton, OR 97005.

A copy of the staff report will be available for inspection at least seven calendar days before the hearing date. Pursuant to Section 50.45.18, within seven (7) calendar days from the date the decision making authority adopts a land use order, the Director shall cause the order to be signed, dated, and mailed to the applicant and the property owner.

EXT2014-0002 (Silverleaf Apartments Time Extension)  The applicant, Edge Development, is seeking a time extension for previously approved Design Review Two (DR2012-0073) and Tree Plan Two (TP2012-0006) applications that authorized the construction of a 13-unit apartment complex and associated tree removal at 1120 SW 160th Avenue.  The site is also described as Tax Lot 1700 on Washington County Tax Assessor’s Map 1S105CB.  No changes to the previously approved applications are proposed.  If approved, the application for time extension will extend the expiration date of the prior approvals to August 10, 2016.

NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that at 6:30 PM on Tuesday, September 9, 2014 the City Council of the City of Beaverton will hold a public hearing to consider withdrawal of the territory described below.  The City Council meeting will be held in the Council Chambers at The Beaverton Building located at 12725 SW Millikan Way, Beaverton, Oregon.  This withdrawal will be considered as part of the Council’s Agenda and is described as follows:

ANX2014-0003, SW JAY ST/BURLINGTON DRIVE WITHDRAWAL OF TERRITORY
Withdrawal from the City of Beaverton property located at 1255 SW Burlington Drive, identified as Tax Lot 300 on Washington County Assessor’s Map 1S105CA, as well as a portion of public right-of-way of SW Jay Street and SW Burlington Drive, as shown on the attached map. This proposal for withdrawal is being administered pursuant to ORS 222.460.

Pursuant to ORS 222.460(1), the Beaverton City Council must find “…that the public interest will be furthered by a withdrawal or detachment of territory from the city…”. The Beaverton City Council must also find that the application meets the criteria of Metro Code Section 3.09.050.

If the City Council favors withdrawal of the territory at the conclusion of the public hearing, the Council may conduct a second and final public hearing on October 7, 2014.  At that public hearing the Council may consider implementation of the withdrawal via ordinance.  If the Council determines at the conclusion of the September 9, 2014 public hearing that the public interest is not furthered by the proposed withdrawal, the Council may enter an order so declaring and no further consideration will be given.  The final decision to favor or reject the proposed withdrawal will represent the City’s final land use decision appealable to LUBA.

You may review a copy of the staff report and all other documents related to this proposed withdrawal at the City’s Community Development Department Public Counter located on the fourth floor of The Beaverton Building.  The staff report is also available on the City’s website at http://www.beavertonoregon.gov/departments/CDD/Development/DevelopmentProjects/. It will be complete by August 25, 2014. For further information you may contact Steven Sparks at (503) 526-2429 or by e-mail at ssparks@BeavertonOregon.gov. Written testimony is acceptable if received by the City Council prior to the hearing.  However, if written comments are not submitted to the Community Development Department by the end of the business day on September 9, 2014, at least ten copies must be provided for distribution at the hearing. Failure to raise an issue during the City Council hearing on the proposal, in person or by letter, accompanied by statements or evidence with sufficient specificity to afford the City Council an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals on that issue.
