NOTICE OF APPLICATION

Pursuant to Section 50.45.4 of the Beaverton Development Code, public notice of the following development application is being provided:
Progress Ridge Town Center PUD Modifications, Phase 1 and Phase 2
CU2009-0007 Village on Scholls Ferry:
Extended Hours of Operation
The applicant requests approval by the Planning Commission to extend the hours of operation for two uses on site. The applicant proposes to extended hours of operation for a coffee shop and convenience market. The convenience market request includes hours of operation from 5:00 a.m. to 12:00 a.m. 7 days a week. The coffee shop request includes hours of operation 5:00 a.m. to 8:00 p.m. Sunday through Thursday and 5:00 a.m. to 12:00 a.m. Friday and Saturday, with drive-through hours of 5:00 a.m. to 8:00 p.m. 7 days a week. Uses operating between 10:00 p.m. and 7:00 a.m. are a conditional use with the Neighbor Service Center zoning district.  There are no physical improvements associated with this Conditional Use Application.
Property located on the east side of the intersection of SW Barrows Road and Scholls Ferry Road. The site is located at 16305, 16315, 16325 SW Barrows Road. The site is described by the Washington County Assessor as Map 2S105 BC, Tax Lot 6900.  The total site occupies approximately 3.16 acres.
The Beaverton Facilities Review Committee will hold a technical meeting with the applicant on the above development applications on July 1, 2009.  The Facilities Review Committee will forward a recommendation to the Director on the above application based on its conformity to the technical criteria specified in Section 40.03 of the Development Code.
The decision making authority for all application will be the Planning Commission (PC), who will review the proposal in accordance with the respective approval criteria of the Development Code.  The PC is scheduled to hold a public hearing on the above development applications on Wednesday, July 22, 2009.   The hearing begins at 6:30 p.m. and will be held in City Council Chambers, 1st Floor, Beaverton City Hall, 4755 SW Griffith Drive.  To be addressed in the staff reports, written comments on the development proposal shall be submitted no later than 5:00 p.m. on Friday, July 10, 2009.  Mailed written comments shall be sent to Anjanette Simon, Planning Division, City of Beaverton PO Box 4755, Beaverton, OR 97005.  Written comments submitted in person shall be delivered to the Planning Division, 2nd Floor, Beaverton City Hall, 4755 SW Griffith Drive.
Pursuant to Section 50.58 of the Beaverton Development Code, written comments or exhibits submitted prior to the hearing to be submitted by staff at the hearing must be received by the Director no later than 4:30 p.m. on the day of the scheduled hearing.  All submittals that are more than two (2) letter size pages must include no fewer than ten (10) complete copies of the materials being submitted.
Copies of the staff reports are available for inspection at the Planning Counter or may be purchased at reasonable cost or are available for on-line viewing at www.beavertonoregon.gov.  Staff reports are published a minimum of seven (7) calendar days before the date of the initial public hearing.

NOTICE OF APPLICATION

Pursuant to Section 50.45.4&6 of the Beaverton Development Code, public notice of the following application is being provided:   Lombard Street Vacation SV2009-0001                                                                                                                                                                          The City Council will conduct a public hearing to consider whether to vacate a portion of surplus public right-of-way located along the east side of SW Lombard Avenue north of SW Canyon Road, in Beaverton. This surplus right-of-way was created in conjunction with the Commuter Rail project and subsequent realignment of SW Lombard Avenue. This proposal would vacate approximately 1,456-square-feet of the surplus right-of-way along the east side of SW Lombard and north of SW Canyon.  Please take note that the Council’s action on this proposed vacation will NOT decide any issues relating to the development of the abutting properties.  Any permits needed to develop those properties will be decided in separate proceedings for which separate public notice will be provided. The subject site is located along the east side of SW Lombard Avenue north of SW Canyon Road.  It is public right-of-way adjacent to TLID#s: 1S115BB 3500                              To be addressed in the staff report, written comments on the above vacation proposal shall be submitted no later than 5:00 p.m. on Friday, July 3, 2009.  Mailed written comments shall be sent to the Planning Division, PO Box 4755, Beaverton, OR 97076.  Written comments submitted in person shall be delivered to the Planning Division, 2nd Floor, Beaverton City Hall, 4755 SW Griffith Drive.

The City Council is scheduled to hold a public hearing on the above application on Monday, July 13, 2009 beginning at 6:30 p.m.  The meeting will be held in City Council Chambers, First Floor, Beaverton City Hall.  Pursuant to Section 50.88 of the Beaverton Development Code, written comments or exhibits submitted prior to the hearing to be submitted by staff at the hearing must be received by the City Recorder no later than 5:00 p.m. on the day of the scheduled hearing.  All submittals that are more than two (2) letter size pages must include no fewer than ten (10) complete copies of the materials being submitted.
