PUBLIC HEARING NOTICE

The West Linn City Council, at its regularly scheduled meeting on Monday, October 12, 2009 starting at 6:30 p.m. in the Council Chambers of City Hall (located at 22500 Salamo Road, West Linn, OR) will hold a public hearing to consider minor amendments to various Chapters of the West Linn Community Development Code (CDC), including Chapters 2, 8, 9, 10, 11, 12, 13, 14, 15, 16, 18, 19, 21, 22, 23, 24, 28, 35, 37, 46, 48, 52, 55, 60, 66, 81, 85, 96, 98 and 99.  These amendments are intended to provide additional clarity to the City’s Code and correct scriveners errors that have been identified in the Code language.  They relate to the Chapters listed above which include the Definitions, Zoning District Regulations, Planned Unit Development, Off-street Parking, Access, Flood Management Areas, Home Occupations, Signs, Conditional Uses, Boundary Changes, Land Divisions, Decision-making procedures, Design Review, Willamette Neighborhood Mixed Use Zoning District regulations, Subdivision regulations and Street Naming sections of the Code.  The Planning Commission recommended approval of these amendments on August 19, 2009.

The applicable standards for the decision are found in Section 98.100.  All documents and applicable criteria in the above-noted file are available for inspection at no cost at City Hall or via the City of West Linn web site at www.westlinnoregon.gov/planning/regulatory-improvement-code-amendment-package, or copies can be obtained for a minimal charge per page.  The At least 10 days prior to the hearing, a copy of the staff report will be available for inspection.  For further information, please contact Chris Kerr, Acting Planning Director, at City Hall, 22500 Salamo Road, West Linn, OR (phone 503-723-2538) or e-mail at ckerr@westlinnoregon.gov .

The hearing will be conducted in accordance with the rules of Section 98.120 of the Community Development Code, adopted December 14, 1987, Ordinance 1129.  Anyone wishing to present written testimony on this proposed action may do so in writing prior to, or at the public hearing.  Oral testimony may be presented at the public hearing.  At the public hearing, the City Council will receive a staff report presentation from the City Planner; and invite both oral and written testimony.  The City Council may continue the public hearing to another meeting to obtain additional information, or close the public hearing and take action on the application.  Failure to raise an issue in person or by letter at some point prior to the close of the hearing, or failure to provide sufficient specificity to afford the decision maker an opportunity to respond to the issue, precludes an appeal to the Land Use Board of Appeals based on that issue.

Downtown Tigard Code Amendments
COMPREHENSIVE PLAN AMENDMENT (CPA) 2009-00003,  DEVELOPMENT CODE AMENDMENT (DCA) 2009-00005, ZONING MAP AMENDMENT (ZON) 2009-00001
REQUEST: A request for approval of Comprehensive Plan Amendments, Development Code Amendments, and Zoning Map Amendments related to the Downtown Urban Renewal District. The request includes changing the Comprehensive Plan Designations of the subject parcels from Central Business District, General Commercial, Commercial Professional, Medium-High Density Residential, Low Density Residential, and Mixed Use Residential 1 to Mixed Use Central Business District. The request also includes changing  the Zoning Map Classifications of the subject parcels from CBD (Central Business District), CBD (PD) (Central Business District-Planned Development Overlay), C-G (General Commercial), C-P (Commercial Professional), R-25 (Residential, 25 units per acre), R-4.5 (Residential, 4.5 units per acre), MUR-1 (Mixed Use Residential 1), R-12 (PD) (Residential, 12 units per acre- Planned Development Overlay) to MU-CBD (Mixed Use Central Business District) and MU-CBD (PD) (Mixed Use Central Business District-Planned Development Overlay. The proposed MU-CBD zone will permit a wide mix of uses. The zone is proposed to be further divided into sub-areas which regulate height and setbacks. Maximum density is proposed to be increased from the currently allowed 40 units an acre to 50 units an acre, plus a station area overlay permitting 80 units per acre. Proposed Development Code Amendments include design and site standards for new development and changes to Sections 18.120, 18.390, 18.520., 18.745, and 18.765. These proposed changes would implement the Comprehensive Plan Text amendments for the Downtown adopted in 2007. LOCATION: The boundaries of the Urban Renewal District (plus seven adjacent properties.)  Generally the area adjacent to Hwy 99W, west of Hwy 217 and Hall Blvd., and east of Fanno Creek.

HEARING DATE: On October 21, 2009, the City of Oregon City – City Commission will conduct a public hearing at 7:00 PM in the City Hall Commission Chambers at City Hall, 320 Warner-Milne Road, Oregon City 97045 on the following item:

The applicant received approval with conditions for a Concept Development Plan for the phased development of the City’s Public Works Facility, which is located at 122 South Center Street in Oregon City.

APPELLANT: McLoughlin Neighborhood Association

REQUEST: The appellant is appealing the Planning Commission’s approval of Planning File CP 009-01.  The appellant asserts that the Planning Commission decision to approve the Public Works Master Plan fails to address, evaluate or adopt findings with regard to the approval criteria for a Concept Development Plan in OCMC section 17.65.050.C and also fails to address the adjustment criteria for each of the adjustments set forth in OCMC section 17.65.070.D.  In addition, the appellant identified the following criteria: A. Procedural; B. Conditions of Approval vis-a-via their appropriateness and or interpretation; C. Municipal Code; D. Dispute of ruling or finding; and E. Testimony not adequately addressed.

The City Commission call-up was not limited as to any particular issues.

LOCATION: The properties are located at 122 S. Center and 121, 206 and 220 S. John Adams and identified as 22E31, tax lot 500; 116 S. CRITERIA: Administration and Procedures are set forth in Chapter 17.50,  and Master Plans in Chapter 17.65 of the Oregon City Municipal Code.  The City Code Book is available on-line at www.orcity.org.

The appeal and all documents submitted by or on behalf of the appellant are available for inspection at no cost at the Oregon City Planning Division, 221 Molalla Avenue, Suite 200, Monday through Friday during regular business hours of 8am to 5pm. The staff report, with all the applicable approval criteria, will also be available for inspection seven days prior to the hearing. Copies of these materials may be obtained for a reasonable cost in advance of the hearing.

Oregon City Municipal Code Chapter 17.50.190 limits standing to those persons who participated either in writing or orally before the Planning Commission on this application. The appeal is on the record presented to the Planning Commission (no new evidence may be submitted).  The City Commission’s decision is the City’s final decision and is appealable to the Land Use Board of Appeals (LUBA) within twenty-one days of when it becomes final by those with standing. The procedures that govern the hearing will be posted at the hearing and are found in OCMC 17.50 and ORS 197.763.  Written comments must be received by the Planning Division by 5pm on October 13, 2009 to be included in the staff report. Written comments received after October 13, 2009 will be forwarded to the City Commission on the night of the hearing.
