The City of Lake Oswego has received an annexation petition for one parcel, which is located within the Urban Service Boundary of the City of Lake Oswego.  The parcel is located at:
5957 Seville Avenue (21E07CD07400)
The Lake Oswego City Council will hold a public hearing on Tuesday, April 20, 2010, at 6:30 p.m. in the City Hall Council Chambers, 380 A Avenue, Lake Oswego, Oregon to consider this annexation petition and proposed ordinance, including the designation of zone(s) for the parcel.

Annexations are adopted by ordinance.  The title of the proposed ordinance is:
Ordinance No. 2550
An ordinance annexing to the City of Lake Oswego one parcel comprising approximately 0.92 acres (located at 5957 Seville Avenue); declaring City of Lake Oswego zoning pursuant to LOC 50.05.025; and removing the territory from certain districts (AN 10-0002).

The Applicants are requesting annexation to obtain City services.  The City zoning designation of R-7.5 will be applied upon the effective date of annexation.

Permitted uses in R-7.5 zones can be found in LOC 50.08.010 and conditional uses in LOC 50.08.015.
Anyone interested in commenting may either speak during the public hearing or submit written comments by 3:00 p.m. on April 20, 2010 to:

The hearing will include an opportunity for persons to testify in favor, in opposition, and neither for nor against, and petitioner’s rebuttal.  Individuals are allowed up to 5 minutes, and another person may cede their time to an individual, in which case no individual shall have more than 10 minutes to testify.  Recognized neighborhood associations, governments and government agencies, and other incorporated public interest organizations have up to 10 minutes to testify.  See LOC 50.83.005 and 58.83.010

Note:  Failure to raise an issue in the hearing, in person or by letter, or failure to provide statements or evidence sufficient to afford the City Council an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based on that issue.

NOTICE OF BUDGET COMMITTEE MEETING
A public meeting of the Budget Committee of the ALTO PARK WATER DISTRICT, Multnomah County, State of Oregon, to discuss the budget for the fiscal year July 1, 2010 to June 30, 2011, will be held at 1735 S.W. Englewood Drive, Lake Oswego.  The meeting will take place on the 15th of April, 2010 at 7:00 p.m.
The purpose of the meeting is to receive the budget message and to receive comment from the public on the budget. A copy of the budget document may be inspected or obtained weekdays on or after April 1, 2010 at the offices of Smith & Greaves, LLP located at 621 SW Morrison, Suite 700, Portland, Oregon 97205 between the hours of 9:00 a.m. and 4:30 p.m.

Decision:
The City Council may make a preliminary or final decision following the hearing.  If the Council approves the request, it will direct the City Manager to act as its agent in executing legal documents to effect the transaction.

Time Limits on Testimony:
The purpose of time limits on testimony is to provide all interested persons with an adequate opportunity to present and respond to testimony while at the same time ensuring that the hearing can be conducted in an efficient and expeditious manner.  The following time limits on testimony shall be observed, but may be changed by the Council:
Testimony will be taken in the following order: in support of amendment, in opposition to amendment, neutral.
•    5 minutes for a representative of a recognized neighborhood association, homeowner association, or government agency, or other incorporated public interest organization;

Vocon, Inc., applicant, is requesting Major Design Review approval of “Key Bank”, an approximately 3,900 square-foot commercial structure with a “drive-thru” facility.  The subject site proposed for the location of “Key Bank” is approximately one-acre in size and is located at the corner of SE Sunnyside Road and SE Misty Drive.  The subject property can be further described as Clackamas County Assessor Map No. 22E01BC: Tax Lot 4000.

The Design Review Board may approve, approve with conditions or deny an application for Major Design Review in accordance with the criteria of the City of Happy Valley Comprehensive Plan, and Sections 16.44.090, 16.46.010, and 16.62.030 of the City of Happy Valley Land Development Code.  All written comments must be received by the City of Happy Valley, 16000 SE Misty Drive, Happy Valley, OR  97086 by 5:00 p.m., on Friday, April 9, 2010.

Testimony should pertain to the applicable criteria.  The decision will be made in accordance with the said criteria, and may be appealed to the City Council.  Failure to raise an issue in person, or by letter at the hearing, or failure to provide statements or evidence sufficient to afford the Design Review Board an opportunity to respond to the issue, means that an appeal based on that issue cannot be filed with the State Land Use Board of Appeals.  The applicant and any person who submits written comments shall receive notice of the decision.

The failure of the applicant to raise constitutional or other issues relating to proposed conditions of approval with sufficient specificity to allow the Design Review Board to respond to the issue precludes an action for damages in circuit court.
