NOTICE OF PUBLIC HEARING

The Milwaukie Planning Commission will hold a public hearing on Tuesday, July 13, 2010, at 6:30 p.m., at the Milwaukie City Hall, 10722 SE Main Street, to consider a development request by Paul Shirey (applicant) and City of Milwaukie (property owner) for approval of Water Quality Resource and Community Service Use applications (File #(s) WQR-10-02; CSU-10-06) to replace the back outdoor deck of the Pond House, a City facility adjacent to the Ledding Library, and improve the front yard landscaping by planting native and adapted shrubs and trees, and installing stepping stones, a bench, and artwork. The Pond House is a former single family residential dwelling, but is now used as a public facility for meetings and related low-intensity activities such as book and poetry readings. Modifications to this approved Community Service Use (CSU) facility requires CSU review. The Pond House property is adjacent to Spring Creek, a protected natural resource, and therefore is completely within the City’s Water Quality Resource (WQR) overlay zone. Modifications to the property, such as an increase in impervious surface areas or changes to the exterior of the house, requires WQR review. The property is located at 2215 SE Harrison St, Tax Lot 01600 of Tax Map 1S1E36BB, and Tax Lot 00900 of Tax Map 1S1E25CC.

Decision:
The City Council may make a preliminary decision following the hearing.  The final City Council decision must be made by adoption of writing findings outlining the reasons for the decision.  That action usually takes place at the next regular Council meeting.

Time Limits on Testimony:
The purpose of time limits on testimony is to provide all interested persons with an adequate opportunity to present and respond to testimony while at the same time ensuring that the hearing can be conducted in an efficient and expeditious manner.  The following time limits on testimony shall be observed, but may be changed by the Council:
Testimony will be taken in the following order: in support of amendment, in opposition to amendment, neutral.
