NOTICE OF PUBLIC HEARING
A public hearing will be held by the Tigard-Tualatin School District (the “District”) beginning at 6:00 p.m. on Monday, August 9, 2010 at the Hibbard Administration Building Board Room, 6960 SW Sandburg St., Tigard, Oregon with respect to the financing by the District of replacement turf for the soccer field at Tigard High School, located at 9000 SW Durham Road, Tigard, Oregon 97224.
The soccer field is owned by the District. The turf financing will be in an amount not to exceed $600,000.
Interested individuals may express their views, both orally and in writing. Oral comments at the public hearing will be limited to 3 minutes for each speaker. SAID PUBLIC HEARING will be held before the Columbia County Planning Commission on Monday, August 2, 2010, at 230 Strand, St. Helens, Oregon, starting at or after 6:30 p.m., at which time proponents and opponents of the proposed application will be heard.
The criteria to be used in deciding the request will be found in some or all of the following documents and laws, as revised from time to time: Oregon Revised Statutes ORS 197.763; Oregon Administrative Rules; Columbia County Comprehensive Plan; Columbia County Zoning Ordinance. The specific criteria applicable to this request is listed and evaluated in the staff report.
A copy of the application, all documents and evidence relied upon by the applicant, and the staff report are available for inspection at no cost and will be provided at reasonable cost at least 7 days prior to the Commission hearing from Land Development Services, County Courthouse Annex, St. Helens, OR, 97051.
If additional documents or evidence are provided in support of the application, any party shall be entitled to a continuance of the hearing. Unless there is a continuance, and if a participant so requests before the conclusion of the evidentiary hearing, the record shall remain open for at least seven days after the hearing.
At each hearing, the applicant has the burden of presenting substantial evidence showing that the application meets all of the applicable criteria. Following presentation of the staff report, the applicant and other persons in favor of the application will be allowed to address the commission, explaining how the evidence submitted meets the applicable criteria. Following the applicant’s presentation, any person in opposition to the application may present evidence and argument against the application. The applicant will then have the opportunity to rebut any evidence or arguments presented in opposition. After the presentation of evidence and arguments, the public hearing record will be closed.
The Commission will then make a tentative decision to be followed by approval of a written order and a statement of findings and conclusions supporting the decision, which will be mailed to all parties at a later date. The Commission may, at its discretion, continue the hearing from time to time at the request of the parties or on its own motion as necessary to afford substantial justice and comply with the law.

ZMA 2010-0013 — R-3.5 ZONING MAP AMENDMENT TO R-5 or R-7 – SW Bruce Ave., South
Notice is hereby given that the Planning Commission will hold a public hearing on the proposed Legislative Zoning Map Amendment on Wednesday, August 4, 2010, beginning at 6:30 p.m. The hearing will be held in City Council Chambers, 1st Floor, Beaverton City Hall, 4755 SW Griffith Drive. The hearing will be conducted in accordance with adopted rules of procedure identified in Chapter 50, Section 50.50. of the Development Code – the Type 4 procedure.
The City is initiating a series of Legislative Zoning Map Amendments (ZMA’s) to change the zoning of all properties zoned R-3.5 throughout the City. The R-3.5 zone becomes obsolete following the effective date of City Council Ordinance No. 4542 which, in part, amends the City of Beaverton Development Code to remove the R-3.5 zone. Through this specific ZMA proposal, all properties zoned R-3.5 on the south side of SW Bruce Avenue will change to one of two possible zones – City R-5 or City R-7. Properties zoned 3.5 on the side of SW Bruce Avenue are generally located south of SW Allen Boulevard, north of SW Denney Road and east of SW Hall Boulevard. Both replacement zones (R-5 and R-7) implement the Standard Density land use designation of City Comprehensive Plan applicable of these properties.
Specific criteria for Legislative Zoning Map Amendment are contained in Section 126.96.36.199.C of the Development Code. Comprehensive Plan policies considered applicable include: Policy “c” under Goal 3.10.1 – Corridor; and Policy “a” under Goal 3.13.3 – Standard Density Residential; and Policy “b” under Goal 188.8.131.52 – Housing; and Policy “d” of Goal 6.2.4. – referring to the Transportation Planning Rule.
Documents and maps for this Legislative Zoning Map are available for review at the Beaverton Community Development Department, 2nd floor, Beaverton City Hall, 4755 SW Griffith Drive, between the hours of 7:30 a.m. to 5:00 p.m., Monday through Friday. In order to be addressed in the staff report, written comments on this proposal must be submitted no later than 4:30 p.m. on Tuesday July 28, 2010.
