CITY OF SCAPPOOSE NOTICE OF A LEGISLATIVE LAND USE PUBLIC HEARING

The Scappoose Planning Commission and City Council have scheduled Legislative Land Use Public Hearings to solicit comments on the following proposed actions:
* Amend the Comprehensive Plan to incorporate 2010 Scappoose Economic Opportunities Analysis (EOA) and 2010-2030 Columbia County population forecast;
* Remove outdated information from the Comprehensive Plan and add key findings and policies from the EOA;
* Add new airport employment Plan designation and overlay zones to implement the EOA;
* Amend Scappoose Urban Growth Boundary to meet industrial and commercial needs identified in the EOA and to include a regional park area.

The initial Planning Commission hearing is scheduled for September 9, 2010 at 7:00 p.m. in the Scappoose City Hall Council Chambers, 33568 E. Columbia Avenue, Scappoose, Oregon. The initial City Council hearing is scheduled for October 4, 2010 at 7:00 PM in the City Hall Council Chambers.

The purpose of the hearings is to take testimony, either written or oral, regarding the proposed amendments. The Planning Commission will make a recommendation to the City Council and the City Council may approve, approve with modifications, or deny the proposed amendments following the Public Hearing.

Legislative changes to the Development Code may affect the use or value of property. Copies of the proposed amendments are available for inspection at the Scappoose Community Development Center (52610 NE 1st Street). Copies are also available for purchase at a cost of $0.15 per page for black & white or $0.20 per page for color. For additional information concerning the amendments, you may call the Planning Department at (503) 543-7184.

Interested parties may submit written comments to the City of Scappoose, City Planner, 33568 E. Columbia Avenue, Scappoose, Oregon, 97056 or fax comments to (503) 543-5679 by 5:00 p.m., Wednesday, September 8, 2010. Failure to raise an issue in person, by letter, or fax prior to the close of the public comment period, or failure to provide sufficient specificity to afford the decision-maker an opportunity to respond to the issue, precludes appeal on that issue.

CITY OF TUALATIN, OREGON

NOTICE IS HEREBY GIVEN that a public hearing will be held before the City of Tualatin City Council at 7:00 p.m., Monday, September 13, 2010, at the Council Building, Tualatin City Center, at 18880 SW Martinazzi Avenue, to consider:

PLAN TEXT AMENDMENT (PTA)—AN ORDINANCE REQUIRING DEVELOPERS TO MITIGATE DEVELOPMENT IMPACTS ON PUBLIC WATER, SANITARY SEWER AND STORMWATER LINES; AND ADDING A NEW SECTION TO TDC CHAPTER 1 (PTA-09-08)

In plain language, this amendment makes explicit that developers must increase the capacity of public lines if their developments generate demand that exceeds operating capacities.

Before granting the proposed amendments, the City Council must find that:  (1) Granting the amendments is in the public interest; (2) The public interest is best protected by granting the amendments at this time; (3) The proposed amendments are in conformity with the applicable objectives of the Tualatin Community Plan; (4) The factors listed in Section 1.032(4) were consciously considered; (5) The Tigard Tualatin School District Facility Plan was considered; (6) The amendments are consistent with the Statewide Planning Goals; (7) The amendments are consistent with the Metro Urban Growth Management Functional Plan; and (8) The amendments are consistent with Level of Service F for the PM peak hour and E for the one-half hour before and after the PM peak hour for the Town Center 2040 Design Type and E/E for the rest of the 2040 Design Types in the City’s planning area.

Individuals wishing to comment may do so in writing to the Planning Division prior to the hearing and/or present written and/or verbal testimony to the City Council at the hearing. Hearings begin with a staff presentation, followed by testimony by proponents, testimony by opponents, and rebuttal. The time of individual testimony may be limited. If a participant requests, before the hearing is closed, the record shall remain open for at least 7 days after the hearing. The failure of the applicant to raise constitutional or other issues relating to proposed conditions of approval with sufficient specificity to the decision maker to respond to the issue precludes an action for damages in circuit court.

Copies of the application, all documents and evidence relied upon by the applicant and applicable criteria are available for inspection at no cost and will be provided at reasonable cost. PUBLIC HEARING

The following will be considered by the Tigard City Council at a Public Hearing on Tuesday September 14, 2010 at 7:00 PM at the Tigard Civic Center – Town Hall, 13125 SW Hall Blvd., Tigard, Oregon.
Public oral or written testimony is invited.  The public hearing on this matter will be held under Title 18 and rules of procedure adopted by the Council and available at City Hall or the rules of procedure set forth in Section 18.390.060.E.  The Planning Commission’s review is for the purpose of making a recommendation to the City Council on the request.  The Council will then hold a public hearing on the request prior to making a decision.

ORS 222.524 Withdrawal of Territory from the Tualatin Valley Water District Subsequent to Annexation to the City of Tigard

A Public Meeting will be held at 7:30 p.m. on Tuesday, September 14 in the Town Hall Conference Room.  This public meeting will allow citizens to provide testimony to City Council regarding this proposed corrective administrative action to legally recognize the present existing utility service boundary and withdraw territory from the Tualatin Valley Water District.

The meeting will determine whether it is in the City’s best interest to complete this “housekeeping” action by ordinance to withdraw territory from Tualatin Valley Water District at the very southern tip of the Metzger area (south of Highway 217, west of I-5, north of Boones Ferry Road and east of the railroad right of way as noted in Exhibits A, B-1 and B-2).

Background:
The proposed area for withdrawal is currently within the city limits of Tigard and is served municipal water by the City of Tigard.  It receives no municipal water service from Tualatin Valley Water District.  All water services including meter reading, billing and collection is provided by the City of Tigard.  This action is proposed to correct the legal description of the area and clarify the existing water service utility boundary between Tigard and Tualatin Valley Water District.  There is no impact to residents or customers through this action.
