PUBLIC HEARING ITEM:
The following will be considered by the Tigard Hearings Officer on Monday January 10, 2011 at 7:00 PM at the Tigard Civic Center – Town Hall, 13125 SW Hall Blvd., Tigard, Oregon.  Both public oral and written testimony is invited.
The public hearing on this matter will be conducted in accordance with the Tigard Municipal Code and the rules of procedure adopted by the Council and available at City Hall or the rules of procedure set forth in Chapter 18.390.  Testimony may be submitted in writing prior to or at the public hearing or verbally at the public hearing only.  Failure to raise an issue in person or by letter at some point prior to the close of the hearing accompanied by statements or evidence sufficient to afford the decision-maker an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based on that issue.  Failure to specify the criterion from the Community Development Code or Comprehensive Plan at which a comment is directed precludes an appeal based on that criterion.
A copy of the application and all documents and evidence submitted by or on behalf of the applicant and the applicable criteria are available for inspection at no cost.  A copy of the staff report will be made available for inspection at no cost at least seven (7) days prior to the hearing, and copies for all items can also be provided at a reasonable cost.

- LEGACY WIRELESS -
PROPOSAL:  Conditional Use Permit for constructing an 896 square foot, unoccupied equipment building that will house telecommunications fiber equipment. The proposal also includes a gravel driveway and a gated gravel yard that will enclose underground utilities.  LOCATION:  15245 SW 74th; Washington County Tax Assessor’s Map 2S112DB, Tax Lot 00700.  ZONE:  I-P: Industrial Park District.  The I-P zoning district provides appropriate locations for combining light manufacturing, office and small-scale commercial uses, e.g., restaurants, personal services and fitness centers, in a campus-like setting. Only those light industrial uses with no off-site impacts, e.g., noise, glare, odor, vibration, are permitted in the I-P zone. In addition to mandatory site development review, design and development standards in the I-P zone have been adopted to insure that developments will be well-integrated, attractively landscaped, and pedestrian-friendly.  APPLICABLE REVIEW CRITERIA:  Community Development Code Chapters 18.330, 18.360, 18.390, 18.530, 18.705, 18.725, 18.745, 18.765, 18.775, 18.790, 18.795 and 18.810.

Pursuant to Section 50.40.4 of the Beaverton Development Code, public notice of the following development application is being provided:

(Camille Park Modifications)
The applicant, Otak, Inc, is seeking Design Review approval to redevelop a portion of Camille Park. The redevelopment involves the removal of the basketball court and the construction of a new picnic shelter, pedestrian bridge, stormwater swale, screened portable restrooms and a boardwalk over the wetlands. Renovation of the existing play equipment is also proposed. Removal of approximately 28% of the DBH (Diameter at Breast Height) of surveyed non-exempt trees within Significant Grove 10 (#G10) is proposed to improve the habitat for the Oregon White Oak. The property is approximately 12.18 acres and located at the West end of SW Marjorie Lane/ SW 105th Avenue.
To be addressed in the staff report, written comments on the above development proposal shall be submitted no later than 5:00 p.m. on Wednesday, January 12, 2011.  Mailed written comments shall be sent to the Planning Division, PO Box 4755, Beaverton, OR 97076.  Written comments submitted in person shall be delivered to the Planning Division, 2nd Floor, Beaverton City Hall, 4755 SW Griffith Drive.
The decision-making authority for the above application is the Director.  Any decision on the above development application shall be based on the Approval Criteria contained in Sections 40.20.15.1.C and 40.90.15.2.C of the Beaverton Development Code.

PROPOSED CODE AMENDMENTS RELATED TO THE APPLICABLITY OF PRE-APPLICATON CONFERENCES AND TEMPORARY SIGNS IN THE PUBLIC RIGHT-OF-WAY ON SUNDAYS

On January 5, 2011 at 7:30 PM, in the West Linn City Hall Council Chambers, (22500 Salamo Road, West Linn) the West Linn Planning Commission will hold a public hearing regarding proposed amendments to Chapters 25, 52, 58, and 99 of the Community Development Code.

The primary purpose of the amendments to the Community Development Code (“CDC”) is to accomplish the following:

1.    Specify exactly which types of development applications are required to hold pre-application conferences prior their submittal.  This amendment is intended to clarify the requirements and centralize their location into Chapter 99 of the Code.

2.    Permit limited temporary signage within the public right-of-way at specific locations on Sundays.

In April of this year the City Council approved Resolutions that instructed Staff to implement these specific policies and which also directed Staff to initiate these Code amendments.

The hearing will be conducted in accordance with the rules of Section 98.120 of the Community Development Code (CDC).  Anyone wishing to present written testimony on this proposed action may do so in writing prior to, or at the public hearing.  Oral testimony may be presented at the public hearing.  At the public hearing, the Planning Commission will receive a staff report presentation from the City Planner, and invite both oral and written testimony.  The Planning Commission may continue the public hearing to another meeting to obtain additional information, or close the public hearing and take action on the application.  Failure to raise an issue in person or by letter at some point prior to the close of the hearing, or failure to provide sufficient specificity to afford the decision maker an opportunity to respond to the issue, precludes an appeal to the Land Use Board of Appeals based on that issue. At least 10 days prior to the hearing, a copy of the staff report will be available for inspection and also on the City’s web site at http://westlinnoregon.gov/planning/sunday-signs-and-pre-application-conference-code-amendments.

Following the hearing, the Planning Commission will make a recommendation to the City Council. The Council will make a final decision regarding the proposed amendments following its own public hearing.

The City of Beaverton intends to issue permits for the proposed Menlo Drive Nature in the Neighborhood Creekside Enhancement project.  The project is located within the FEMA (Federal Emergency Management Agency) designated 100-year floodplain and affects the 100-year floodway of Erickson Creek, a major tributary to Beaverton Creek.  The work anticipated consists of removing over 10,000 cubic yards of soil providing additional flood storage adjacent to Erickson Creek near the southeast corner of the intersection of Farmington Road and Menlo Drive, north of Fairmont Drive.
Additionally, wetland plantings and street storm drainage improvements are included in the project.  Written appeals, based solely on anticipated adverse effects of this work, may be filed with the City Recorder on or before 5:00 PM, PDT, December, 27, 2010.  This notice is intended to meet the requirements of Beaverton City Code, Section 9.05.085.  A copy of this code and the proposed plans are available for examination at Beaverton City Hall, Second Floor, Community Development Department, 4755 SW Griffith Dr., Beaverton, Oregon.
