TIMBER FOR SALE, UNITED STATES DEPARTMENT OF THE INTERIOR, BUREAU OF LAND MANAGEMENT.  ORAL AUCTION OR SEALED BIDS as hereinafter designated will be received by the District Manager, Bureau of Land Management, 1717 Fabry Road, S. E., Salem, Oregon 97306, at 9:00 am Pacific Time, on Wednesday, August 24, 2011, for all timber marked or designated for cutting.  Before bids are submitted, full information concerning the timber, the conditions of sale and submission of bids, including appraised prices per species, should be obtained from the above District Manager.  The right is hereby reserved to waive technical defects in this advertisement and to reject any or all bids.  The United States reserves the right to waive any informality in bids received whenever such waiver is in the interest of the United States.  This sale notice, first published on July 27, 2011, constitutes the decision document for purposes of protests and appeals, under 43 CFR Subpart 5003 – Administrative Remedies.  At the time of this notice of sale, what constitutes a protestable decision is limited to 1) whether there has been new BLM direction requiring a change from that in the Gunners Lakes Project EA and/or 2) changes between the timber sale design as described in the Gunners Lakes Project EA and that in the final Timber Sale contract.  BLM must receive protests of any sale listed below within 15 days after the first publication of this notice.  The regulations do not authorize the acceptance of protests in any form other than a signed, written hard copy that is delivered to the physical address of the advertising BLM office.  As such the original signed protest must be received by the close of business 4:30 p.m. on the 15th day of the protest period.  This project is also consistent with court orders relating to the Survey and Manage mitigation measure of the Northwest Forest Plan, as incorporated into the Salem District Resource Management Plan, including Judge Pechman’s Order from October 11, 2006, stipulating four exemptions.  This project meets one of the specified exemptions.  Specific project details can be found in the related NEPA documents.

Notice is hereby given that a ballot title for a measure referred by the City of Scappoose has been filed with the Columbia County Clerk on July 22, 2011.
The ballot title is:
Caption:  Charter amendment specifying procedures on appointment, tie votes, council vacancies.
Question:  Shall Scappoose amend its City Charter to clarify definitions, and specify procedures on Mayoral appointments, tie votes and Council vacancies?
Summary:   If enacted, this Charter amendment would clarify the definition of Council Member, for purposes of a quorum and taking certain votes. It would add a requirement of Council approval for Mayoral appointments to committees and would update the procedure for determining the winner of tie vote for elected office. It would remove the requirement that Council declare a vacancy of an elected Council position office if the position office holder dies, is declared incompetent, is convicted of a felony, resigns or is recalled from office.  A Council declaration by Council of a Council position vacancy in office would continue to be required unless it is determined for a determination that the elected official fails to possess qualifications for office, fails to qualify for office within 3 days of the time for term of office to commence, or is absent without consent from Council meetings for 60 days.
An elector may file a petition for review of this ballot title in the Columbia County Circuit Court no later than 5:00 p.m., August 2, 2011 (which is the 7th business day after receipt.)

The Scappoose Planning Commission has scheduled a Limited Land Use Decision to consider the following application:

DOCKET # SDR5-11
An application for Site Development Review submitted by Baysinger Partners Architecture PC. The request is for review of a proposed 19,514 square foot retail store to be owned and operated by Goodwill Industries. The site is located on the southwest corner of SE 2nd Street and SE Frederick Street, on property described as Columbia County Assessor Map # 3213-AC-03400.

The meeting is scheduled for Thursday, August 11, 2011, at 7:00 p.m. in the Council Chambers of Scappoose City Hall located at 33568 East Columbia Avenue. Site Development Review is a Limited Land Use Decision and does not require a public hearing (verbal testimony will not be considered).

The Planning Commission’s decision on the above items must be based on findings that a specific set of criteria have been or have not been met.  Comments submitted in regard to the application should be directed toward applicable sections of Title 17 (Land Use and Development) of the Scappoose Municipal Code, with particular emphasis on Chapters 17.68 (EC, Expanded Commercial); 17.100 (Landscaping, Screening and Fencing); 17.104 (Street Trees); 17.106 (Off-Street Parking and Loading Requirements); Chapter 17.120 (Site Development Review); 17.154 (Street and Utility Improvement Standards); and 17.164 (Procedures for Decision Making–Limited Land Use Decisions).

The City of Scappoose proposes to amend the Development Code to grant authority to the City Planner to decide most applications for public land tree removal while retaining Planning Commission authority over some applications, and to update the approval criteria and procedural requirements for public land tree removal applications. These applications are generally required in advance of removing street trees and other trees on public land.

The Planning Commission hearing is scheduled for August 11, 2011 at 7:00 p.m. in the Scappoose City Hall Council Chambers, 33568 E. Columbia Avenue, Scappoose, Oregon. A subsequent hearing by the City Council is scheduled for September 6, 2011 at 7:00 PM in the City Hall Council Chambers.

The purpose of the hearings is to take testimony, either written or oral, regarding the proposed amendments. The Planning Commission will make a recommendation to the City Council and the City Council may approve, approve with modifications, or deny the proposed amendments following the Public Hearing.

Legislative changes to the Development Code may affect the use or value of property. Copies of the proposed amendments are available for inspection at the Scappoose Community Development Center (52610 NE 1st Street). Copies are also available for purchase at a cost of $0.15 per page for black & white or $0.20 per page for color. ZMA 2010-0011 – CENTRAL BEAVERTON OFFICE COMMERCIAL/ CONVENIENCE SERVICE CENTER ZONE MAP AMENDMENT:
The City is initiating a series of legislative zoning map amendments (ZMA’s) to replace obsolete zones with either new or existing zoning map districts.  For this specific ZMA, the proposal is to amend the Zoning Map to delete the obsolete Office Commercial (OC) and Convenience Service Center (CV) zones and apply the Community Service (CS) and/or Neighborhood Service Center (NS) zones.  The subject site is a developed area, consisting of (3) three parcels. The subject parcels are generally located in Central Beaverton, two (2) parcels along Farmington Rd and one (1) parcel near the corner of Jenkins Rd and Cedar Hills Blvd. No new development is proposed as a part of this application.
