PUBLIC HEARING ITEM:
The following will be considered by the Tigard Hearings Officer on Monday November 14, 2011 at 7:00 PM at the Richard Brown Auditorium, 8777 SW Burnham Street, Tigard, Oregon.  Both public oral and written testimony is invited.
The public hearing on this matter will be conducted in accordance with the Tigard Municipal Code and the rules of procedure adopted by the Council and available at City Hall or the rules of procedure set forth in Chapter 18.390.  Testimony may be submitted in writing prior to or at the public hearing or verbally at the public hearing only.  Failure to raise an issue in person or by letter at some point prior to the close of the hearing accompanied by statements or evidence sufficient to afford the decision-maker an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based on that issue.  Failure to specify the criterion from the Community Development Code or Comprehensive Plan at which a comment is directed precludes an appeal based on that criterion.
A copy of the application and all documents and evidence submitted by or on behalf of the applicant and the applicable criteria are available for inspection at no cost.  A copy of the staff report will be made available for inspection at no cost at least seven (7) days prior to the hearing, and copies for all items can also be provided at a reasonable cost.

CONDITIONAL USE PERMIT (CUP) 2011-00002/ADJUSTMENTS (VAR) 2011-00019 & 2011-00020
- WESTSIDE CHRISTIAN HIGH SCHOOL -
REQUEST:  The applicant is requesting approval for a Conditional Use Permit for a new school use on the property recently rezoned from C-P (professional commercial) to MUE (mixed use employment). The proposal will expand the existing building from 36,750 square feet to 64,200 square feet and include indoor and outdoor athletic facilities to accommodate up to 450 students. Adjustments to the rear yard setback (on Pacific Hwy) from 30 feet to 24 feet and a reduction of the minimum bicycling parking requirements from 72 spaces to 16 spaces are also requested.  LOCATION:  The property is located at 8200 SW Pfaffle Street.  The site is bounded by SW Pfaffle on the north, Hwy. 217 on the west, and Pacific Hwy. on the south; Washington County Tax Assessor’s Map 1S136CC, Tax Lot 100.  ZONE:  MUE: Mixed-Use Employment. The MUE zoning district is designed to apply to a majority of the land within the Tigard Triangle, a regional mixed-use employment district bounded by Pacific Highway (Hwy. 99), Highway 217 and I-5. This zoning district permits a wide range of uses including major retail goods and services, business/professional offices, civic uses and housing; the latter includes multi-family housing at a maximum density of 25 units/acre, equivalent to the R-25 zoning district. A wide range of uses, including but not limited to community recreation facilities, religious institutions, medical centers, schools, utilities and transit-related park-and-ride lots, are permitted conditionally. Although it is recognized that the automobile will accommodate the vast majority of trips to and within the Triangle, it is still important to (1) support alternative modes of transportation to the greatest extent possible; and (2) encourage a mix of uses to facilitate intradistrict pedestrian and transit trips even for those who drive. The applicant is seeking approval of Design Review II, Land Division, and Tree Plan II applications in order to construct an approximate 4,120-square-foot new financial institution with a walk-up ATM and a 3-lane drive-through. The site contains 3 single-family dwellings and approximately 20 Community Trees which are proposed to be removed to accommodate the construction of the proposed development. The decision-making authority for the above application is the Director.  Any decision on the above development application shall be based on the Approval Criteria contained in Development Code Sections Development Code Sections 40.03 Facilities Review, 40.20.15.2 Design Review Two, 40.45.15.3.C Preliminary Partition, 40.90.15.2.C Tree Plan II of the Beaverton Development Code.

TriMet, the Tri-County Metropolitan Transportation District of Oregon, will hold a public hearing to obtain public comments on a petition for withdrawal of the Boring Oregon area (an unincorporated area in Clackamas County described below), from the TriMet district.

If the Boring Oregon area were withdrawn, the TriMet self-employment and payroll tax rate in the remainder of the TriMet district would be increased from .007118 to .007137.

The Summit will take place at the Lake Oswego High School Library, including a community mixer from 5:30-6:00 p.m. where you can talk with community groups involved in community culture. The workshop runs from 6:00-8:00 p.m.
