Nature of Application and Use or Uses which could be authorized:
A request from the City of Lake Oswego for legislative amendments to the Lake Oswego Community Development Code (CDC) to limit the sizes of specified retail uses in the Mixed Commerce (MC) and Industrial Park (IP) zones.  Proposed amendments to the CDC will bring the City into compliance with Title 4 of Metro’s Urban Growth Management Functional Plan.  The MC and IP zones are located within an Employment District on Metro’s Title 4 map.
On October 24, 2011, the Planning Commission recommended that the City Council approve the proposed amendment.

An ordinance of the Lake Oswego City Council amending LOC Chapter 50 (Community Development Code), Article 50.11 to limit the square footage of retail uses in the Mixed Commerce (MC) zone, Article 50.13 to limit the square footage of retail uses in the Industrial Park (IP) zone, and adopting Findings (LU 11-0028).

Decision:
The City Council may make a preliminary decision following the hearing.  The final City Council decision must be made by adoption of writing findings outlining the reasons for the decision.  That action usually takes place at the next regular Council meeting.
Time Limits on Testimony:
The purpose of time limits on testimony is to provide all interested persons with an adequate opportunity to present and respond to testimony while at the same time ensuring that the hearing can be conducted in an efficient and expeditious manner.  The following time limits on testimony shall be observed, but may be changed by the Council:
Testimony will be taken in the following order: in support of amendment, in opposition to amendment, neutral.
• 10 minutes for a representative of a recognized neighborhood association, homeowner association, or government agency, or other incorporated public interest organization;
•  5 minutes for other persons.

Pursuant to Oregon Revised Statutes 305.583 (9) and (10), notice is hereby given that on November 22, 2010 and January 23, 2012, Forest Grove School District No. 15, Washington County, Oregon (the “District”) adopted resolutions (a) classifying the tax levy to be imposed to pay the principal of, premium, if any, and interest on the District’s issuance of general obligation bonds in the aggregate principal amount not to exceed $65,300,000 as not being subject to the limits of section 11 or 11b, Article XI of the Oregon Constitution, and (b) specifying the authorized uses of the proceeds of the general obligation bonds.  Any individual may contact the Director of Business and Support Services of the District at 1728 Main Street, Forest Grove, Oregon 97116, telephone (503) 359-2425, to obtain a copy of the resolution.  Judicial review of the classification of the taxes or the specification of authorized uses may be sought within 60 days of the date of the resolution of January 23, 2012.

Interested parties are invited to attend this hearing or to submit comments in writing prior to the meeting time.  Written testimony may be submitted in advance or in person at the hearing.  Those wishing to present verbal testimony, either pro, con, or to raise questions, will be asked to speak after presentation of the reports.

Testimony should pertain to the applicable criteria.  The decision will be made in accordance with said criteria, and may be appealed to the Land Use Board of Appeals.  Failure to raise an issue in writing prior to or before the close of the written comment period or failure to provide sufficient specificity at the public hearing to afford the decision-making body an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based upon that issue.  The applicant and any person who submits written comments shall receive notice of the decision.

The failure of the applicant to raise constitutional or other issues relating to proposed amendments without sufficient specificity to allow the decision-making body to respond to the issue precludes an action for damages in circuit court.
