The Clackamas County Board of Commissioners will hold a public hearing at 10:00 a.m., on Thursday, September 27, 2012, in the Board Hearing Room, Fourth Floor Room 409 of the Public Service Building, 2051 Kaen Road, Oregon City, Oregon, to consider any objection or testimony regarding the transfer of jurisdiction of portions of Pilkington Rd., McEwan Rd., Bonita Rd., and Kenny St. to the City of Lake Oswego.  The City of Lake Oswego, by Intergovernmental Agreement and Council Resolution Nos. 12-06 and 12-43 dated April 3, 2012 and July 24, 2012, has requested Clackamas County to transfer the aforementioned roads to the City.

Notice of District Measure Election

Notice is hereby given that on November 6, 2012, a special election will be conducted by mail in conjunction with the General Election in the County of Clackamas County, Oregon, at which time will be submitted to qualified voters of the City of Gladstone the following question:
CAPTION:    Authorization to construct and incur debt to finance new library
QUESTION:    Shall Gladstone authorize construction and incurrence of a maximum debt of $7.5 million to finance a new $10 million library?
SUMMARY:    This measure authorizes the Gladstone City Council to incur debt through the issuance of municipal bonds to finance and construct a new Gladstone library.
Funding sources to finance, construct, and operate the new library:
•    Clackamas County Capital Contribution – One
time contribution of $2.5 million.
•    Clackamas County Library Fund – Library support of approximately $1.32 million per year, increased from $537,000 the City currently receives.
•    Gladstone Urban Renewal Agency Funds – Current and future revenues for the Gladstone Urban Renewal Agency ranging from $140,763 to $261,070 per year depending on loan repayment period.
•    City General Fund- Increased Clackamas County Library District funds for library operations will allow the City to redirect General Fund money of approximately $114,365 per year that is currently allocated for library operations to pay part of debt incurred for the library.
The design for the new library is approximately 97% complete. The City has spent $1,189,278 and cannot recover that money if the project is not completed.

There are no new taxes associated with this proposal.

This ballot title was received by the City Recorder of the City of Gladstone on Wednesday, August 23, 2012.  An elector may file a petition for review of this ballot title with the Circuit Court of Clackamas County  no later than 5 p.m. on August 30, 2012.  Any elector who files a petition to review the ballot title must notify the City Recorder in writing that the petition has been filed no later than 5:00 PM on the next business day following the day the petition is filed.

Water Right Transfer T-11147

T-11147 filed by Tim Jannsen, for Sunrise Water Authority, 10602 SE 129th Ave., Happy Valley, OR 97086, proposes a point of appropriation change under Certificate 43436. The right allows the use of 0.26 cfs from Well 1 in Sec. 5, T 2 S, R 3 E, W.M. for municipal use in Sec. 32, 33, 34 & 35, T 1 S, R 3 E and Sec. 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 15, 16, 17 & 18, T 2 S, R 3 E, W.M.  The applicant proposes to replace Well 1 with two wells in Sec. 9, T 2 S, R 3 E.  The Water Resources Department proposes to approve the transfer, based on the requirements of ORS Chapter 540 and OAR 690-380-5000.

Clackamas Fire District #1 is now accepting applications to fill one vacancy on its Board of Directors.  This uncompensated position will be filled by a majority vote of the remaining four directors.  The appointment will complete the four-year term position, which expires on June 30, 2013.  Candidates must be at least 18 years of age, and must be either an elector or a property owner within the Fire District.  Applications must be received by 4:00 p.m. on Friday, Sept. 21, 2012.  Those interested in obtaining an application may find it on the Fire District’s website at www.clackamasfire.com or by contacting the District’s Administrative Office at 11300 SE Fuller Road, Milwaukie, OR  97222 or by phone at (503) 742-2600.

CRITERIA:
Administration and Procedures are set forth in Chapter 17.40, Historic Overlay District in Chapter 17.40, and “ MUC”  Chapter 17.29 of the Oregon City Municipal Code. The City Code Book is available on-line at www.orcity.org
The application and all documents submitted by or on behalf of the applicant are available for inspection at no cost at the Oregon City Planning Division, 221 Molalla Avenue, Suite 200 from 8:00AM-5:00PM. The staff report, with all the applicable approval criteria, will also be available for inspection seven days prior to the hearing. Copies of these materials may be obtained for a reasonable cost in advance.

Any interested party may testify at the public hearing or submit written testimony at or prior to the hearing. Written comments must be received by the Planning Division by September 14, 2012 to be included in the staff report. The procedures that govern the hearing will be posted at the hearing and are found in OCMC Chapter 17.50 and ORS 197.763.

Please be advised that any issue that is intended to provide a basis for appeal must be raised before the close of the hearing, in person or by letter, with sufficient specificity to afford the Historic Review Board and the parties an opportunity to respond to the issue. Failure to raise an issue with sufficient specificity will preclude any appeal on that issue. The decision of the Historic Review Board may be appealed to the City Commission by parties with standing. Any appeal will be based on the record. A city-recognized neighborhood association requesting an appeal fee waiver pursuant to 17.50.290(C) must officially approve the request through a vote of its general membership or board at a duly announced meeting prior to the filing of an appeal.
