PUBLIC NOTICE

TIMBER FOR SALE, UNITED STATES DEPARTMENT OF THE INTERIOR, BUREAU OF LAND MANAGEMENT. ORAL AUCTION as hereinafter designated will be received by the Salem District Manager, or her representative, at the Salem District Office, 1717 Fabry Road, S.E., Salem, Oregon until 9:00 a.m. on Wednesday, June 22, 2016, for all timber marked or designated for cutting. Before bids are submitted, full information concerning the timber, the conditions of sale and submission of bids, including appraised prices per species, should be obtained from the Tillamook Resource Office. The right is hereby reserved to waive technical defects in this advertisement and to reject any or all bids. The United States reserves the right to waive any informality in bids received whenever such waiver is in the interest of the United States. This sale notice, first published on May 27, 2016, constitutes the decision document for purposes of protests and appeals, under 43 CFR Subpart 5003 – Administrative Remedies for the conduct of this advertised timber sale. At the time of this notice of sale, what constitutes a protestable decision is limited to 1) whether there has been new BLM direction requiring a change from that analyzed and documented in the South Scappoose Creek Project Environmental Assessment and associated Decision Record (EA# DOI-BLM-OR-S060-2011-0007-EA) and/or 2) changes between the timber sale design as described in the EA for portions of unit 9 (hereafter referred to as Baker’s Dozen Timber Sale) and found in the final Timber Sale contract. The BLM must receive protests of the sale listed below within 15 days after the first publication of this notice. The regulations do not authorize the acceptance of protests in any form other than a signed, written hard copy that is delivered to the physical address of the advertising BLM office. As such the original signed protest must be received by the close of business 4:30 p.m. on the 15th day of the protest period.

The BLM has prepared a Determination of NEPA Adequacy (DOI-BLM-ORWA-S060-2016-0005-DNA) that documented whether the Baker’s Dozen Timber Sale is consistent with the assessment from the EA and the BLM found that, while there are minor deviations from the EA in layout design and new road construction location and length, the assessment is still valid. This timber sale is in conformance with the Salem District 1995 Resource Management Plan, as amended. The South Scappoose Creek project, from which the Baker’s Dozen Timber Sale is generated, is consistent with court orders relating to the Survey and Manage mitigation measure of the Northwest Forest Plan, as amended by the 2001 Survey and Manage Record of Decision (without annual species reviews) and incorporates one of the exemptions from Judge Pechman’s Order from October 11, 2006.
