19TH AVENUE SIDEWALK CATEGORY OF BID: CONSTRUCTION ENGINEER’S

The City of Albany hereby extends an invitation to submit bids for:
MS-16-04, 19th Avenue Sidewalk: This project includes construction of approximately 775 feet of new sidewalk and related appurtenances.
Bids submitted shall be filed in sealed envelopes, and received at the City of Albany Parks & Recreation counter, not later than 2:00 p.m., Tuesday, July 26, 2016, addressed to the attention of Diane M. Murzynski, CPPO, Purchasing Coordinator, at Albany City Hall, Finance Department, 333 Broadalbin Street SW, Albany, OR 97321. The outside of the envelopes shall plainly identify: (1) the Project name, (2) the Bid Opening time and date, (3) the Bidder’s name, and (4) the Contractor’s license number (per ORS 701). Immediately following the filing deadline, the bids shall be opened and publicly read in the Calapooia Room of City Hall. It is imperative those who download the contract bid documents check the website regularly for addenda, clarifications, and other pertinent notifications. All who are known by the City of Albany to have received a complete set of the contract bid documents will receive notification when additional items are posted. Each bidder must have access to a current set of City of Albany Standard Construction Specifications, which can be found on the City’s website at https://www.cityofalbany.

All work performed on the project will be subject to federal Davis-Bacon wage rates. This project is funded by a Community Development Block Grant from the U.S. Department of Housing and Urban Development.
In addition, City contracts contain a statement declaring that the bidder agrees to comply with the federal labor standards provisions of the Davis-Bacon and Related Acts (40 USC 3141-3148; and 29 CFR Parts 1, 3, 4, 5, and 7) and State provision required by ORS 279C.800 through 279C.870 regarding payment of prevailing wages. Bidders must be in compliance with all applicable federal laws and regulations described in the Office of Management and Budget “Super Circular.” The Contractor must certify that it will abide by the “Federal Labor Standard Provisions” outlined in Form HUD-4010, the “Payment of Employees” outlined in HUD Form-5282, and sign the “Certification Regarding Lobbying” as imposed by Section 1352, Title 31, U.S. Code.
The City’s contract contains a clause which incorporates by reference all of the provisions of ORS Chapter 279C which are applicable to public contracts. Bidders are expected to be familiar with these provisions including, but not limited to, recent changes to ORS Chapter 279C.
The Bidder is required to comply with and adhere to all applicable Federal laws and regulations described in 24 CFR 570 Part K, except that the Contractor does not assume the City’s environmental review responsibilities described in 24 CFR Part 560.605, and for initiating the review process under the provisions of 24 CFR Part 52. The Bidder must agree to comply with the Federal Water Pollution Control Act, as amended, 33 U.S.C., 1251, et seq., as amended, 1318 relating to inspection, monitoring, entry, reports, and information, as well as other requirements specified in Section 114 and Section 308. In addition, if contracts and subcontracts exceed $100,000, the Bidder must agree to comply with the Clean Air Act, as amended, 42 USC 1857 et seq., the Federal Pollution Control Act, as amended (33 U.S.C. 1251 et seq.), and the regulations of the Environmental Protection Agency at 40 CFR Part 15, as amended, and must comply with the training, employment and business opportunities as specified Section 3 of the Housing and Urban Development Act of 1968 (12 U.S.C. 1701u).
No bid shall be received or considered unless the bidder is licensed by the Construction Contractors Board for construction projects or licensed with the State Landscape Contractors Board for landscaping projects.
A 10% bid bond, certified check, or cashier’s check shall accompany each bid on all projects and shall be forfeited if the bidder fails to enter into a Contract with the City of Albany within ten (10) days after the date of the Notice of Award.
