NOTICE IS HEREBY GIVEN that a public hearing will be held before the Hillsboro Planning and Zoning Hearings Board, at or shortly after 6:30 p.m., on Wednesday, October 19, 2016, in the Shirley Huffman Auditorium of the Hillsboro Civic Center, 150 E Main Street, Hillsboro. At this hearing, the Board will reconsider a request for conditional use approval for a major assembly facility in the I-S Industrial Sanctuary zone, on a property approximately 4.58 acres in size. The Board is withdrawing their previous decision to approve a Conditional Use and related Variance application for the Islamic Community Center of Hillsboro due to testimony being received during the comment period that was inadvertently omitted from the staff report and materials presented to the Board for its consideration at their regular meeting on September 7, 2016. The testimony raised concerns with respect to potential site flooding and area traffic conditions. The Board will open a new hearing to consider the written testimony, and will take new testimony limited to the issues raised in the previously omitted testimony. The Board would then close the hearing, incorporate new testimony in its findings, and render new decisions on each of the applications, which would replace the previous decisions. The Conditional Use request is to allow the operation of a major assembly facility for up to 297 people in the I-S Industrial Sanctuary (I-S) zone. Site improvements include a 134-space gravel parking lot, a 22,500 square foot park on the south east corner of the lot, two pedestrian bridges, landscaping and utilities. The Variance request is to allow a reduced 20-foot setback along NW Helvetia Road and NW Pubols Road for the building and the parking lot instead of the standard 35-foot requirement of the I-S zone.

The subject property is specifically identified as Tax Lot 203 on Washington County Assessor’s Tax Map 1N2-15. The property owner is Issam Abu-Khater, Islamic Community Center of Hillsboro (ICCH), and the applicant is Mansoor Abbas, ICCH.

The applicable approval criteria for a Conditional Use application may be found in the Hillsboro Community Development Code (CDC), Section 12.80.020. The CDC may be viewed online at www.hillsboro-oregon.gov/communitydevelopment code or in the Planning Department office.

The staff report on this matter will be available on Wednesday, October 12, 2016 at 4:00 p.m. The staff report, the application materials, and the applicable criteria are available for public inspection at no cost, or copies can be provided at reasonable cost, from 8:00 a.m. to 5:00 p.m. weekdays, excluding holidays, in the Planning Department at the Hillsboro Civic Center, 150 E Main Street, 4th floor, Hillsboro, Oregon.

All interested persons are invited to attend this meeting and will be given an opportunity to be heard concerning the proposal. Oral testimony will be taken in the following order: applicant; other proponents; opponents; and applicant’s rebuttal. Oral testimony should avoid repetition of issues, and should be based on the application or on the approval criteria listed above. ORS 197.763 provides that under certain circumstances, the record may remain open or a continuance may be granted upon the request of a participant. If you are unable to attend the hearing, you may submit a written statement to the Planning Director at the address listed above, on or before the hearing date. Telephone conversations cannot be accepted as testimony. Please reference the Case File No. on all written testimony.

Pursuant to ORS 197.763, failure to raise an issue at the final evidentiary hearing, or by close of the record, in person or by letter, or failure to provide statements or evidence sufficient to afford the decision maker an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based on that issue.
