NOTICE OF APPLICATION
Pursuant to Section 50.45.4 of the Beaverton Development Code, public notice of the following development application is being provided:
AM Kennedy Park; CU2011-0004 /  DR2011-0088 / SDM2011-0002 / TP2011-0006  The applicant requests a New Conditional Use, Design Review 3, Sidewalk Design Modification, and Tree Plan approval to improve and upgrade facilities at AM Kennedy Park:
• New Conditional Use (Type 3) reviews areas of the park which were not part of the original approval and will be reviewed as a new park. New Parks are a conditional use under the R-10 zoning district.
•Design Review 3 (Type 3) reviews construction and installation of an approximately 180 x 300-square-foot multi-use sports field for the use of children 14 years old and under, a community garden, foot bridge for crossing into the park from SW Laurel Road, picnic area/shelter, plaza, upgrades for pathways, play and park equipment, and the creation of approximately 20 on-street parking spaces designated for park use. The programmed use of the field will be for 14 years and under, the field will be available for the public and non-organized groups when the field is not under a scheduled use. Older groups will not be scheduled. The proposal also includes landscape, wetland improvements, and other site improvements.
• Sidewalk Design Modification (Type 1) reviews the modification of standards for sidewalks along SW Laurel. The half street improvement to SW Laurel Street will require a sidewalk design modification because of the lack of space to complete pedestrian improvements without impacting creek side natural resources. The proposal is to remove existing pavement on the north side at the dead end intersection with 103rd and reduce the street width to 20’ (minimum fire access width). The proposal includes retaining the existing 27’ street section on Laurel Street, instead of increasing the width to the 28’ as required for this street type in order to protect the creek side natural resources.
• Tree Plan (Type 2) will review a request for is the removal of 5 or more community trees on the undeveloped area on site. The request includes the removal of approximately 57 trees from a total of 613 trees from the entire site in order to accommodate the proposed improvements, the trees are a mix of Community Trees and trees from Significant Tree Grove #16 located on site.
The subject site is located at approximately 10300 SW Kennedy Street.
Tax Lots:  #1S114BC00301, 1S114BC00200, 1S114BC00100, 1S114BA05204. The subject site is approximately 4.69 acres in size.
To be addressed in the staff report, written comments on the above development proposal shall be submitted no later than 5:00 p.m., Monday, September 26, 2011.  Mailed written comments shall be sent to the Development Services Division, PO Box 4755, Beaverton, OR 97076.  Written comments submitted in person shall be delivered to the Development Services Division, 2nd Floor, Beaverton City Hall, 4755 SW Griffith Drive.  Pursuant to Section 50.58 of the Beaverton Development Code, written comments or exhibits to be submitted by staff at the hearing must be received by the Director no later than 5:00 p.m. on the day of the scheduled hearing.  All submittals that are more than two (2) letter size pages must include no fewer than ten (10) complete copies of the materials being submitted.
The Beaverton Facilities Review Committee will hold a technical meeting with the applicant on the above development application on Wednesday, September 21, 2011.  The Facilities Review Committee will forward a recommendation to the Director on the above application.
The decision-making authority for the above application is the Planning Commission, which will review the proposal in accordance with the approval criteria contained in Development Code Sections: 40.03 Facilities Review, 40.15.15.C New Conditional Use, 40.20.15.3.C Design Review Three, 40.58.15.C Sidewalk Design Modification, 40.90.15.2.C Tree Plan II.  The Planning Commission is scheduled to hold a public hearing on the above development application on Wednesday, October 12, 2011, beginning at 6:30 p.m.  The meeting will be held in City Council Chambers, 1st Floor, Beaverton City Hall, 4755 SW Griffith Drive.
Copies of the staff report are available for inspection at the Development Services Division Planning Counter or may be purchased at reasonable cost or are available for on-line viewing at www.ci.beaverton.or.us.  Staff reports are published a minimum of seven (7) calendar days before the date of the initial public hearing.
