TRUSTEE’S NOTICE OF SALE Reference is made to a certain trust deed (Trust Deed) made, executed and delivered by Inheritance Holding Company LLC, an Oregon limited liability company, as the Grantor; Fidelity National Title, as the Trustee; and Columbia Community Bank, its successors and assigns, as the Beneficiary under that certain trust deed dated March 5, 2008, recorded on April 9, 2008, as Recording No. 2008-032017, in the Mortgage Records of Washington County, Oregon (Deed of Trust), and re-recorded on April 21, 2009, as Recording No. 2009-034108, in the Mortgage Records of Washington County. The Deed of Trust has been modified by a Modification of Deed of Trust recorded on October 6, 2008, as Recording No. 2008-083653, in the records of Washington County, Oregon and re-recorded on April 21, 2009 as Recording No. 2009-034109, in the records of Washington County, Oregon. The Deed of Trust was further modified by a Modification of Deed of Trust recorded September 2, 2011, as Recording No. 2011-061160, in the records of Washington County, Oregon. The beneficial interest in the property was conveyed to Premier Community Bank, an Oregon corporation (formerly known as Columbia Community Bank), by instrument recorded September 25, 2017, as Recording No. 2017-075418. The Trust Deed covers the following described real property (Property) situated in said county and state, to-wit: PARCEL I: The following bounded and described real property situate within Washington County, Oregon, and being a part of Lots 6 and 7, in Block 1 of the original townsite of the town (now city) of HILLSBORO, Washington County, Oregon. Beginning at a point on the South line of said Lot 7, 49.5 feet East from the Southwest corner thereof and running thence North 100 feet to the North line of what is now known as Woods Building, thence West 10 feet; thence North 98 feet to the North line of said Lot 6, and at a point 159 feet West of the Northeast corner of said Lot, running thence East 60 feet to the Northwest corner of that tract conveyed to Robert R. Herb and Brenda Herb by instrument recorded in Book 1138, Page 617, Washington County Deed Records; thence along the West line of said Herb tract South 7 4 feet; thence Southeast to a point which is 11 feet North of the South line of said Lot 6 and 29 feet East of the East line of that certain tract of land described in that certain Deed made to Orange Phelps and which is recorded in Book 119, Page 240, of the Records of Deeds of Washington County, Oregon, and running thence West on the South line of a tract of land described in Deed Recorded in Book 128, Page 499, of the Records of Deeds for Washington County, Oregon, 19 feet to the most Northerly Northwest corner of that tract conveyed to L. J. Gress, et ux, by Deed Recorded in Book 983, Page 39, Washington County Deed Records; thence following the Westerly line of said Gress tract South 11 feet; thence West 10 feet to the East line of that certain tract of land conveyed in that certain Deed Recorded in Book 119, Page 240, of the Records of Deeds for Washington County, Oregon, running thence South on the East line of said tract described in said Book 119, Page 240, to a point 10 feet North of the North wall of the Shute Building in Lot 7, in said Block; thence in a Southwesterly direction to a point which is the Northwest corner of the said Shute Building and which is 80 feet North of the South line of said Lot 7 and 69.5 feet East from the West line of said Lot 7, thence South 80 feet to the South line of Lot 7, and the Southwest corner of said Gress tract; thence West on the South line of Lot 7, 20 feet to the place of beginning. PARCEL II: An Easement for ingress and egress over the following described property: FIRST TRACT: Beginning at the Northwest corner of Lot 6, Block 1, HILLSBORO, in the City of Hillsboro, County of Washington and State of Oregon; thence East 39.5 feet, more or less, to the West line of that tract conveyed to Town Hill Theatres, Inc., an Oregon corporation, by Deed recorded in Book 898, Page 372, Washington County Deed Records; thence South, along the West line of said Town Hill Theatres, Inc. Tract, 35 feet; thence West 39.5 feet to the West line of said Lot 6; thence North to the place of beginning. SECOND TRACT: Beginning at a point on the North line of Block 1, HILLSBORO, in the City of Hillsboro, County of Washington and state of Oregon, which point is 198 feet East of the Northwest corner of said Block 1; thence South 198 feet; thence East 12 feet; thence North 198 feet to the North line of said Block 1; thence West 12 feet to the place of beginning. PARCEL Ill: Part of a tract of land conveyed to Nye 0. Bristol and Marie J. Bristol, husband and wife, recorded in Book 227, Page 623, Deed Records of Washington County, Oregon, described as follows: Beginning at a point on the North line of Main Street at a point which is 99 feet West of the Southeast corner of Lot 7, Block 1, HILLSBORO, in the City of Hillsboro, County of Washington and State of Oregon; thence North 110 feet to a point; thence West 14 1 /2 feet to a point; thence South 20 feet to a point; thence Southwesterly 17 1/2 feet to a point; thence South 80 feet to the South line of said Block 1; thence East 29 1/2 feet to the point of beginning. EXCEPTING THEREFROM that certain tract conveyed to Orange Phelps by Deed recorded in Book 128, Page 622, Deed Records of Washington County, Oregon. There are defaults by the grantor or other person owing an obligation, the performance of which is secured by the Trust Deed, with respect to provisions therein which authorize sale in the event of default of such provision; the defaults for which foreclosure is made is grantor’s failure to pay when due the following sums: (1) Loan Ending 003: Arrearage in the sum of $62,725.00 as of December 27, 2017, plus additional payments, property expenditures, taxes, liens, assessments, insurance, late fees, attorney’s and trustee’s fees and costs, and interest due at the time of reinstatement or sale. (2) Loan Ending 006: Arrearage in the sum of $2,196.25 as of December 27, 2017, plus additional payments, property expenditures, taxes, liens, assessments, insurance, late fees, attorney’s and trustee’s fees and costs, and interest due at the time of reinstatement or sale. (3) Loan Ending 007: Arrearage in the sum of $3,137.50 as of December 27, 2017, plus additional payments, property expenditures, taxes, liens, assessments, insurance, late fees, attorney’s and trustee’s fees and costs, and interest due at the time of reinstatement or sale. (4) Grantor’s failure to protect Lender’s security interest by its failure to pay real property taxes for 2017-2018. (5) Grantor’s failure to protect Lender’s security interest in the property by its failure to keep property free of liens and judgments. By reason of said defaults, the beneficiary has declared all sums owing on the obligations secured by said Trust Deed immediately due and payable, said sums being the following, to-wit: Payoff in the sum of $923,498.65 as of December 27, 2017, plus taxes, liens, assessments, property expenditures, insurance, accruing interest, late fees, attorney’s and trustee’s fees and costs incurred by beneficiary or its assigns. WHEREFORE, notice hereby is given that the undersigned trustee will on June 6, 2018, at the hour of 11:00 a.m., in accord with the standard of time established by ORS 187.110, at the following place: Outside the Front Entrance of the Washington County Courthouse, 145 NE 2nd Avenue, Hillsboro, Oregon, sell at public auction to the highest bidder for cash the interest in the above-described Property, which the grantor had or had power to convey at the time of the execution by grantor of the said Trust Deed, together with any interest which the grantor or grantor’s successors in interest acquired after the execution of the Trust Deed, to satisfy the obligations thereby secured and the costs and expenses of sale, including a reasonable charge by the trustee. Notice is further given that any person named in ORS 86.778 has the right, at any time prior to five days before the date last set for the sale, to have this foreclosure proceeding dismissed and the Trust Deed reinstated by payment to the beneficiary of the entire amount then due (other than such portion of the principal as would not then be due had no default occurred) and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation or Trust Deed, and in addition to paying said sum or tendering the performance necessary to cure the default, by paying all costs and expenses actually incurred in enforcing the obligation and Trust Deed, together with trustee’s and attorney’s fees not exceeding the amounts provided by said ORS 86.778. Without limiting the trustee’s disclaimer of representations or warranties, Oregon law requires the trustee to state in this notice that some residential property sold at a trustee’s sale may have been used in manufacturing methamphetamines, the chemical components of which are known to be toxic. Prospective purchasers of residential property should be aware of this potential danger before deciding to place a bid for this property at the trustee’s sale. In construing this notice, the singular includes the plural, the word grantor includes any successor in interest to the grantor as well as any other person owing an obligation, the performance of which is secured by said Trust Deed, and the words trustee and beneficiary include their respective successors in interest, if any.
