NOTICE OF PUBLIC HEARING City of Happy Valley Design Review Board Notice is hereby given that the City of Happy Valley Design Review Board will hold a public hearing on the following date regarding an application for a Design Review Amendment associated with Building C of the previously approved Christilla Commons subdivision. Date & Time: Wednesday, November 28, 2018 at 7:00 p.m. Hearing Location: City Hall, 16000 SE Misty Drive, Happy Valley, OR 97086 File & Subject: File No. DRA-01-18 (Design Review Amendment) Proposal: Design Review Amendment to Building C of the previously approved Christilla Commons subdivision. Building C was originally approved as a four-level mixed-use commercial building comprised of 16,300 square feet of ground floor commercial space, a second story with 19 apartment units, a third story on the north half of the structure with seven apartment units and a lower level parking garage with 38 parking spaces for the residential tenants. The proposed amendment would add an additional eight units to the south half of the third story. Location: 12930 SE 162nd Avenue, further described as Clackamas County Assessor Map No. 22E06BB: Tax Lot 804. The decision on the Design Review Amendment of the previously approved mixed-use commercial building (Building C) by the Design Review Board will be made in accordance with said criteria. Failure to raise an issue in writing prior to or before the close of the written comment period, Tuesday, November 6, 2018 by 5:00 p.m. or failure to provide sufficient specificity at the public hearing to afford the Design Review Board an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based upon that issue. The applicant and any person who submits written comments shall receive notice of the decision. The failure of the applicant to raise constitutional or other issues relating to proposed conditions of approval with sufficient specificity to allow the Design Review Board to respond to the issue precludes an action for damages in circuit court.
