NOTICE OF APPLICATION is hereby given that on Wednesday, August 15, 2012 at 6:30 p.m. in the Forrest C. Soth Council Chambers of Beaverton City Hall, located at 4755 SW Griffith Drive, Beaverton, Oregon; the Planning Commission of the City of Beaverton will consider the application, described below, in accordance with the adopted rules of procedure.
TA2012-0012 WIRELESS COMMUNICATIONS FACILITIES TEXT AMENDMENT:
The City is proposing to amend Chapters 20, 40, and 50 of the Development Code to comply with FCC Declaratory Ruling 09-99 for processing times for wireless facility collocations under the ruling. In addition, amendments are proposed under Chapter 60 of the Development Code for screening standards and requirements for landscaping. Finally, several definitions are proposed to be added to Chapter 90; Definitions. In particular, the definitions for “substantial increase” and “eligible facilities request” are included as these are required as part of a new law enacted February 2012. These definitions are in relation to any proposed collocation of a wireless communications facility. The new definitions allow for review with limited exercise of discretion.
The Planning Commission will be the initial decision-making authority for the above proposed ordinance actions and will review the TA proposal in accordance with the approval criteria contained in Section 40.85.15.1.C of the Development Code of the City of Beaverton. The Beaverton City Council is the final decision-making authority for the application.
Copies of the application, documents and evidence submitted in relation to this application are available for inspection or may be purchased at reasonable cost at the City’s Planning Division public counter, located on the 2nd floor of Beaverton City Hall Monday through Friday from 7:30 a.m. to 5:00 p.m. Copies of the staff report will be available for inspection or may be purchased at reasonable cost at the City’s Planning Division public counter, during the days and hours noted above, seven (7) calendar days prior to the hearing. Pursuant to Section 50.45.4 of the Beaverton Development Code, public notice of the following development application is being provided:
ADJ2012-0002, CU2012-0006, DR2012-0053, LD2012-0004 VillaSport at 45 Central
The applicant, VillaSport LLC, requests approval by the Planning Commission to construct a recreational facility at approximately 87,000 square feet. The proposed recreational facility includes indoor and outdoor recreation space as well as associated parking and site improvements. The applicant requests approval of a Conditional Use permit for a recreational facility in the SC-MU zone. The applicant is also seeking a Minor Adjustment to the maximum front yard setback as well as a Replat to consolidate two existing lots of record. The site is located at the northeast corner of SW Murray Boulevard and SW Jenkins Road. The site is described as Tax Lot 1400 on Washington County Tax Assessor’s Map 1S109BB, also identified as Lots 228 and 299 in the 45 Central Plat.
The Beaverton Facilities Review Committee will hold a technical meeting with the applicant on the above development applications on July 11, 2012. The Facilities Review meeting is open to the public, but is not intended for public testimony. The Facilities Review Committee will forward a recommendation to the Director and Planning Commission on the above application based on its conformity to the technical criteria specified in Section 40.03 of the Development Code.
The decision making authority for all application will be the Planning Commission (PC), who will review the proposal in accordance with the respective approval criteria found in the Development Code, Section 40.03 Facilities Review, Section 40.10.15.1.C Minor Adjustment, Section 40.15.15.3.C Conditional Use, Section 40.20.15.3.C Design Review Three, and Section 40.45.15.2.C Replat. Also the following policies of the Comprehensive Plan: policies “a through c” of Goal 5.8.2, policies “a through c” of Goal 5.4.1, policies “a through c” of Goal 5.5.1, policies “a and b” of Goal 5.6.1, policies “e” and “j” of Goal 6.2.2, and policy “a” of Goal 8.4. The PC is scheduled to hold a public hearing on the above development applications on Wednesday, August 1, 2012. The hearing begins at 6:30 p.m. and will be held in City Council Chambers, 1st Floor, Beaverton City Hall, 4755 SW Griffith Drive.
