NOXIOUS VEGETATION ABATEMENT NOTICE

No owner or person in charge of property shall allow noxious vegetation to be on the property or in the right-of-way of a public thoroughfare (including public alleys) abutting on the property. An owner or person in charge of property shall cut down or destroy noxious vegetation as often as needed to prevent it from becoming a health or fire hazard, or, in the case of weeds or other noxious vegetation, from maturing or from going to seed.

Noxious vegetation includes poison oak, poison ivy, English ivy, blackberry bushes, grass or weeds more than 12 inches high, scotch broom, and all other vegetation included in the Oregon Department of Agriculture’s Noxious Weed Control Policy and Classification System. FOREST GROVE TRANSPORTATION
SYSTEM PLAN UPDATE

NOTICE IS HEREBY GIVEN that the Forest Grove City Council will hold a Public Hearing on Monday, January 27, 2014, at 7:00 PM or thereafter, in the Community Auditorium, 1915 Main Street, Forest Grove, to consider the update to the Forest Grove Transportation System Plan (TSP).

The TSP was last updated in 2010.  The focus of the current TSP update is to make the twenty-year planning time horizon consistent with Regional Transportation Plan (update from Year 2030 to Year 2035) and to base the TSP on the land uses prepared as part of the Comprehensive Plan update.  The TSP update also addresses requirements contained in the Metro Regional Transportation Functional Plan.

The proposed TSP includes a preferred roadway network as shown on the map.

The TSP also contains goals and policies for the transportation system, and identification of existing conditions and future travel demand.  The TSP includes a pedestrian system plan, bicycle system plan, transit plan and financing and implementation strategy.  The TSP identifies specific transportation projects expected to be undertaken by the City and other agencies over the next twenty-years.  Additional information is available for review on the City’s website at:

All interested parties may appear and provide testimony to the City Council. Only those persons participating may appeal the City’s decision on this matter in accordance with applicable State statutory provisions relating to appeals of decisions amending an acknowledged comprehensive plan.

The City must adopt specific findings of fact addressing the following criteria: consistency with the applicable policies of the Forest Grove Comprehensive Plan, consistency with the Metro Regional Transportation System Plan, Metro Regional Framework Plan, Metro Regional Transportation Functional Plan, Metro Urban Growth Management Plan and Oregon Statewide Planning Goals, and Oregon Transportation Planning Rule (OAR 660-012-000 et. seq.) as applicable.

NOTICE IS HEREBY GIVEN that the Forest Grove City Council will hold a Public Hearing on Monday, December 9, 2013, at 7:00 p.m. or thereafter, in the Community Auditorium, 1915 Main Street, Forest Grove, to consider adopting an ordinance that would repeal and reenact existing Code Chapter 6, Vehicles and Traffic, to adopt provisions regulating general vehicle and traffic regulations and penalties, including abandoned, discarded and impounded vehicles; parking regulations and citations;  bicycles; and parade-related events within the City limits. The proposed ordinance, if enacted by the City Council, would take effect 30 days immediately after enactment unless City Council declares an emergency.

NOTICE IS HEREBY GIVEN that the Forest Grove City Council will hold a Public Hearing on Monday, December 9, 2013, at 7:00 p.m. or thereafter, in the Community Auditorium, 1915 Main Street, Forest Grove, to consider adopting a resolution fixing solid waste rates to be charged by a franchise, Waste Management. The proposed resolution, if enacted by the City Council, would take effect immediately, and the changes in the passed through fees would result in a four (4%) percent increase in monthly rates for 20, 35, 60, and 90-gallon roll carts for residential and commercial services, effective January 1, 2014.

NOTICE IS HEREBY GIVEN that the Forest Grove Planning Commission will hold a Public Hearing on Monday, December 2, 2013, at 7:00 PM or thereafter, in the Community Auditorium, 1915 Main Street, Forest Grove, to consider amendments to the Forest Grove Comprehensive Plan. The amendments are being initiated by the City of Forest Grove under the Periodic Review Program and Post Acknowledgement Plan Amendment procedures described in Oregon Revised Statutes Chapter 197.610 through 197.628.

ZONING DESIGNATION

NOTICE IS HEREBY GIVEN that the Forest Grove City Council will hold a Public Hearing on Monday, October 14, 2013, at 7:00 p.m., or thereafter, in the Community Auditorium, 1915 Main Street, Forest Grove, to consider a property owner initiated annexation petition for property located at 3351 NW Thatcher Rd. (Washington County Assessor Map and Tax Lot Number 1N4260000400).  The subject property is approximately 5.6 +/- acres in land area.

On October 14, 2013, the Forest Grove City Council will consider an ordinance annexing the subject property into the City of Forest Grove and withdrawing the subject property from the Forest Grove Rural Fire Protection District, Washington County Enhanced Sheriff Patrol District and Washington County Urban Road Maintenance District.  The proposed ordinance, if enacted by the City Council, would take effect on the thirtieth day (30th) after enactment.  The Forest Grove City Council will also consider an order assigning a City of Forest Grove Zoning District to the subject property.

Under Article 2, Section 10.2.150, of the Forest Grove Development Code, annexation is reviewed according to the procedures in Oregon Revised Statutes Chapter 222 (Boundary Changes, Mergers and Consolidations) and Chapter 3.09 of the Metro Code (Local Government Boundary Changes).

Under Chapter 3.09 of the Metro Code the City Council must adopt findings that the annexation is consistent with:

1.    Adopted urban service agreements and annexation plans;
2.    Comprehensive Plan provisions applicable to annexation; and
3.    Applicable provisions contained in adopted public facility plans.

In addition, the City Council must consider whether the annexation would:

1.    Promote the timely, orderly, and economic provision of public facilities and services;
2.    Affect the quality and quantity of urban services; and
3.    Eliminate or avoid unnecessary duplication of facilities and services.

Zoning of the property annexed into the City of Forest Grove shall meet the review criteria in Section 10.2.770 of the Forest Grove Development Code as follows:

A.    The zone change is consistent with the Comprehensive Plan Map;
B.    The zone change is consistent with relevant goals and policies of the Comprehensive Plan, as identified by the Director;
C.    The site is suitable for the proposed zone and there is a lack of appropriately designated alternative sites within the vicinity;
D.    The zone change is consistent with the adopted Transportation System Plan;
E.    Public facilities and services for water supply, sanitary waste disposal, storm water disposal, and police and fire protection are capable of supporting the uses allowed by the zone; and
F.    The establishment of a zone district is not subject to the meeting of conditions.

Forest Grove City staff and Planning Commission’s recommendation is to rezone the subject property upon annexation from FD-10 (County 10-Acre Minimum Lot Size) to R-10 (City) Single-Family Residential (10,000 Square Foot Lot Size).
