REQUEST:        Comprehensive Plan Amendment approval is requested to allow conflicting uses on 0.42 acres of significant wetlands, designated on the Comprehensive Plan’s Wetlands and Stream Corridor map as Goal 5 Safe Harbor/Significant Wetlands. The remaining 6.20-acres of significant wetlands on the site would continue to prohibit conflicting uses and be protected under Goal 5 Safe Harbor/Significant Wetlands.

Sensitive Lands Review approval is requested to allow modification to the 100-year floodplain of Ash Creek on the site to include reshaping the existing ground surface to decrease the areal extent of the floodplain on the site without modifying the flood storage capacity or floodwater transmission capacity of the floodplain on the site.

Planned Development Combined Concept Plan and Detailed Development Plan approval is requested for the plans for development of 215 multi-family residential dwelling units in four buildings on an 11.17-acre site on the south side of SW Oak Street within the Washington Square Regional Center Plan Area. The proposed planned development would preserve over 6-acres of the site as permanent open space including wetlands and riparian area adjacent to Ash Creek, and would include the provision of pedestrian trail easements to the City for development of future pedestrian trails in this area.

LOCATION:    The subject property is located on the south side of SW Oak Street opposite SW 90th Avenue                 at 8900, 8950, 8960, 8980, and 9000 SW Oak Street; comprised of Washington County Tax                 Map 1S1 35AC Tax Lots 4000, 4100, 4200, 4300, and 4400 and Washington County Tax Map                 1S1 35AD Tax Lot 1303.

ZONE:        MUE-1, Mixed Use Employment; MUR-1, Mixed Use Residential.

PUBLIC HEARING ITEM:
The following will be considered by the Tigard City Council on Tuesday, August 12, 2014 at 7:30 PM at the Town Hall, 13125 SW Hall Blvd., Tigard, Oregon.  Both public oral and written testimony is invited.

APPEAL OF CONDITIONAL USE PERMIT
(CUP) 2013-00002 – COSTCO FUEL STATION
REQUEST:  This is an appeal of an approved Conditional Use Permit and Tigard Triangle Design Evaluation Team (DET) decision for the construction of a members-only retail fueling station located at the existing Costco site.  The station is proposed at the northeast corner of the site currently used for parking.  The facility consists of a 72 foot by 102 foot canopy with three fueling islands, nine fuel dispensers and four underground storage tanks.  The proposal also includes reconfiguration of the parking area surrounding the proposed fueling station and landscaping.

LOCATION:  The property is located at 7850 SW Dartmouth Street; Washington County Tax Assessor’s Map 1S136CD, Lot 2200. ZONE:  C-G: General Commercial District (PD). The C-G zoning district is designed to accommodate a full range of retail, office and civic uses with a city-wide and even regional trade area.  Except where non-conforming, residential uses are limited to single-family residences which are located on the same site as a permitted use.  A wide range of uses, including but not limited to adult entertainment, automotive equipment repair and storage, mini-warehouses, utilities, heliports, medical centers, major event entertainment, and gasoline stations, are permitted conditionally. Proposals will be received until 2:00 p.m. local time, Tuesday, July 1, 2014, at Tigard City Hall’s Utility Billing Counter at 13125 SW Hall Blvd., Tigard, Oregon 97223.

No proposal will be considered unless fully completed in a manner provided in the RFP packet. Facsimile and electronic (email) proposals will not be accepted nor will any proposal be accepted after the stated due date and time. Any proposal received after the closing time will be returned to the submitting firm unopened after a contract has been awarded for the required services.

2014 Summer Pavement Crack Seal

The City of Tigard will receive sealed bids from qualified firms at Tigard City Hall’s Utility Billing Counter located at 13125 SW Hall Blvd., Tigard, Oregon 97223 until 3:00 pm local time, Thursday, May 8, 2014 for the 2014 Summer Pavement Crack Seal construction project. Bids will be opened and publicly read aloud immediately after the bid’s closing time and date at Tigard City Hall.

The project generally consists of the following:

1. Installation of crack seal on city streets
2. Temporary signage, protection, and traffic control
3. Performance of additional and incidental work as called for by the specifications and plans.

Basis of Bid Award shall incorporate all items identified on the Bid Schedule.

Pursuant to Tigard Public Contracting Rule 30.055, all bidders must submit a bid security to the City along with their bid in an amount equal to ten percent (10%) of their base bid. In the event a bid exceeds $100,000, Bidders must submit a First Tier Subcontractor Disclosure Form, provided in this packet, to the City no later than 5:00 pm local time, May 8, 2014.

The City anticipates this will be a prevailing wage rate project. The provisions of ORS Chapters 279A and 279C and all other Oregon and Federal provisions pertaining to minimum salaries and wages shall be incorporated by reference as if fully set forth in any contract resulting from this Invitation to Bid. Contractor shall provide proof to the City prior to the beginning of any of the work that the Contractor has filed a public works bond with a corporate surety in the amount of $30,000 with the Construction Contractors Board as required under Oregon PWR law.
