NOTICE OF HEARING

NOTICE IS HEREBY GIVEN THAT AT 6:00 PM ON THURSDAY, APRIL 18, 2013, IN THE COMMISSIONER’S HEARING ROOM, 2051 KAEN ROAD, OREGON CITY, OREGON THERE SHALL BE A PUBLIC HEARING BY AND BEFORE THE CLACKAMAS COUNTY BOARD OF COMMISSIONERS ON THE BOUNDARY CHANGE PROPOSAL LISTED BELOW.  INTERESTED PERSONS MAY APPEAR AND WILL BE GIVEN A REASONABLE OPPORTUNITY TO BE HEARD.

PROPOSAL NO. CL-0612 – ANNEXATION TO CLACKAMAS COUNTY SERVICE DISTRICT NO. 1 of territory located in the eastern part of the District as follows:

Parcel A located north OF THE Clackamas River, south of Jennifer Street, west of 120th Ave. and east of Robert Ave., more particularly:  Tax Lots 1200, 1500, 1501 & 1700 NE ¼ Sec. 15 AND Tax Lots 100 & 190 NW ¼ Sec. 15 all in T2S R2E;

Parcel B located south of Aldridge Rd. at 143rd Place, more particularly: Tax Lot 800 and r-o-w of 143rd Place in SW ¼ SW ¼ Sec. 36, T1S R2E;

Parcel C located on the south edge of Monner Rd., more particularly:  Tax Lot 100 SW ¼ SE ¼ Sec. 36, T1S R2E;

Parcel S located along the west edge of SE 92nd Ave. north of Hinkley Ave., more particularly:  Tax Lots 8800 & 8901 NE ¼  NW ¼ Sec. 28, T1S R2E;

Parcel T located along the east edge of SE 172nd Ave. south of  Hemrick Rd., more particularly:  Tax Lot 1200 NE ¼ Sec. 31, T1S R3E;

Parcel U located on the north edge of the Clackamas River near the end of Wilde Rd., more particularly:  Tax Lot 2300 NE ¼ Sec. 15 AND Tax Lots 800, 900, 1100, 1500, 1501, 1502, 1590 & 2800 SW ¼ Sec. 14, T2S R2E;

Parcel V located on the north edge of the Clackamas River near the end of Wilde Rd., more particularly:  Tax Lots 400, 500, 501, 502, 600, 601, & 602 SW ¼ Sec. 14, T2S R2E;

Parcel W located on the east edge of SE 152nd  Ave. south of SE Frye St., more particularly:  Tax Lot 500, 505, 590 & 595 NE ¼ Sec. 1, T2S R2E;

All of the W.M., Clackamas County, OR.

The property owners desire sewer service to facilitate eventual development and/or to serve existing development.

The decision on annexation to the District does not authorize or prevent any specific use of land.  Current County or City zoning and planning designations will not be affected by this proposed change.

Applicable criteria may be found in the Metro Code 3.09.050 and ORS 198.850 (2).

Failure to raise an issue in the hearing, orally or in writing, with specificity and clarity sufficient to allow the Commission or any participant to address and respond to such issue may preclude appeal to the Oregon Land Use Board of Appeals of the Board’s resolution of that issue.

A copy of the application, all documents and evidence submitted by or on behalf of the applicant and applicable criteria are available for inspection at no cost and will be provided at reasonable cost.

A copy of the staff report will be available for inspection at no cost 15 days before the hearing and will be provided at reasonable cost.
