NOTICE IS HEREBY GIVEN that the City of Happy Valley Community Development Department is reviewing land use applications for a three-lot land partition (File No. LP-02-11) and an Environmental Review Permit (File No. ERP-01-11) submitted by Valley View Evangelical Church. The subject property is located at 11501 SE Sunnyside Road and consists of approximately 13.4 acres of land currently zoned Low Density Residential (R-10) by the City. The purpose of the applicant’s proposal is to partition an existing Lot of Record into three parcels, one containing the existing church and the other two will be slated for future development. The Environmental Review Permit is required by the City due to the subject site containing environmentally sensitive lands. The applicant has also proposed a Comprehensive Plan map amendment/zone change on the subject site to change its current zoning designation to Mixed Use Commercial (MUC) and Institutional and Public Use (IPU) as part of another application that will be heard by the City’s Planning Commission at their December 13, 2011 meeting (see attached notice). The subject property is further described as Clackamas County Assessor Map No. 12E34D: Tax Lot 1600.
The Community Development Department may make a decision to approve, approve with conditions or deny the subject applications, in accordance with the applicable review criteria of the City of Happy Valley Comprehensive Plan, and Chapters 16.22, 16.34, 16.41, 16.42, 16.50, 16.51 and 16.63 of the City of Happy Valley Land Development Code. All written comments must be received by the City of Happy Valley, 16000 SE Misty Drive, Happy Valley, OR 97086 by 5:00 p.m., on Friday, November 18, 2011.
Public comments should pertain to the applicable review criteria. If any person fails to address the relevant review criteria with enough detail, they may not be able to appeal to the Land Use Board of Appeals or Circuit Court on that issue. Only comments on the relevant approval criteria are considered relevant evidence.
All evidence relied upon by the Planning Official or designee to make this decision is in the public record, available for public review. Copies of this evidence can be obtained at a cost from the City.
After the comment period closes, the Planning Official or designee shall issue a Type II administrative decision, and that the decision shall be mailed to the applicant and to anyone else who submitted written comments or who is otherwise legally entitled to notice
