2012 Tiered Environmental Review
Notice of Intent to Request Release of Funds
The City of Beaverton, as an entitlement grantee under the CDBG program has applied for Federal Community Development Block Grant (CDBG) funds from the US Department of Housing and Urban Development (HUD).  The City of Beaverton hereby announces that it has conducted a tiered environmental review for area-wide factors as provided under 24 CFR part 58 for the following projects:
1. Downtown Storefront Improvement Program, 2. Hope-4-Homes,   3. Adapt-a-Home, 4. Mend-a-Home.
In the first tier, a broad area-wide statutory review identified laws and authorities has been determined not to be triggered.  However, some environmental factors cannot be determined until specific activities and/or properties become known.  Once specific site determination has been made, a second tier review will be analyzed for relevant environmental impacts to assure compliance with Historic Preservation, Floodplain, and Toxic Chemicals and Radioactive Materials.  Any mitigation measures required to alleviate or minimize adverse impact will be implemented prior to final approval of CDBG funding for individual activities.
An Environmental Review Record (ERR) that documents the environmental determinations from the tier one review for the listed projects are on file at Beaverton City Hall, Community and Economic Development Department 2nd Floor, 4755 SW Griffith Drive, Beaverton, OR 97005, and may be examined or copied weekdays, 8 A.M. to 5 P.M. PUBLIC COMMENTS: Any individual, group or agency may submit written comments on the ERR to the City of Beaverton’s Community and Economic Development Department.  All comments received by 5 P.M. on Thursday, April 26, 2012. RELEASE OF FUNDS: On or about April 27, 2012, the City of Beaverton will submit a “Request for Release of Funds and Certification” to HUD for CDBG funds.  The City of Beaverton certifies to HUD that Denny Doyle in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s/State’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City of Beaverton to use CDBG funds. OBJECTIONS TO RELEASE OF FUNDS:
HUD  will accept objections to its release of funds and the City’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Name of City of Beaverton; (b) the City has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to HUD grant administration office at Address of that office. Potential objectors should contact HUD to verify the actual last day of the objection period.
