CITY OF DONALD NOTICE OF PUBLIC HEARING DATE: February 23, 2017 TIME: 6:45 P.M. PLACE: Donald City Council Chambers, 10710 Main Street NE, Donald FILE: ANX-2017-01/ZC-2017-01/CPMA-2017-01 APPLICANT/OWNER: James P. Feller, 5071 Eagleton Way, Granite Bay, CA 95746 PROJECT LOCATION: Map 041W17BC Lot 400 (subject property is located northwest of the intersection of Butteville Road NE and Donald Road NE). PROPOSED LAND USE: The applicant is requesting annexation of approximately 1.12 acres, generally located northwest of the intersection of Butteville Road NE and Donald Road NE. Upon annexation, the Donald Comprehensive Plan identifies the subject property to be zoned Commercial (C). The Planning Commission will hold a public hearing, review the application and make a recommendation to the City Council. The City Council will then conduct a public hearing to review the planning commission’s recommendations and make a decision on the application. The City Council hearing is tentatively scheduled for Tuesday, March 14, 2017 at 6:45 p.m. ——————————————————————- CITY COUNCIL NOTICE OF PUBLIC HEARING DATE: March 14, 2017 TIME: 6:45 P.M. PLACE: Donald City Council Chambers, 10710 Main Street NE, Donald PLANNING COMMISSION AND CITY COUNCIL HEARING PROCESS: The public hearing on this matter will be conducted in accordance with the rules of Oregon Revised Statutes (ORS) 222.005 through 222.183. Anyone wishing to present written testimony on this proposed action may do so in writing prior to or at the public hearing. Oral testimony may be presented at the public hearing. At the public hearing, the city council will review a staff report, open the public hearing and invite both oral and written testimony. These documents are available for review at City Hall. Information submitted in support of this application after March 7 , 2017 will allow any interested party to request a continuance of this application. The City Council may continue the public hearing to another meeting to obtain additional information, or close the public hearing and take action on the application. Unless there is a continuance, if a participant so requests before the conclusion of the initial evidentiary hearing, the record shall remain open for at least seven (7) days after the hearing. An issue that may be the basis for an appeal to the Land Use Board of Appeals (LUBA) shall be raised not later than the close of the record at or following the final evidentiary hearing on this case. Such issues shall be raised with and accompanied by statements or evidence sufficient to afford this body, and the parties to this hearing an adequate opportunity to respond to each issue. It is the responsibility of the applicant in this matter to raise constitutional or other issues relating to any proposed conditions of approval. The failure of the applicant to raise such issues with sufficient specificity to allow this body to respond to this issue precludes an action for damages in circuit court. All documents in the above-noted file are available for inspection at City Hall at no cost or 8 by 11 copies can be obtained for $0.25 per page. At least seven (7) days prior to the hearing, a copy of the staff report will be available for inspection at no cost, or a copy can be obtained for $0.25 per page.
