NOTICE OF PUBLIC HEARINGS City of North Plains NOTICE IS HEREBY GIVEN that on April 12, 2017, the City of North Plains Planning Commission will hold an open Public Hearing to invite comments on the following three proposals: 1. City File Number 17-032: Proposed amendments to Chapter 16 of the Municipal Code. The changes will specifically affect the sign code (16.080) and the floodplain development code (16.065). Changes are also proposed to Chapters 16.085 (home occupations), 16.170 (procedures) and 16.175 (design review) for consistency with the proposed changes to 16.080 (sign code). The proposed changes are intended to update the sign code and clarify the process for obtaining a floodplain development permit. The applicable code section is 16.200 (Comprehensive Plan & Zoning Amendments). Once the Planning Commission has made a recommendation on the proposal, the recommendation will be referred to the City Council for a Monday, May 1, 2017 public hearing, or another date certain as stated at the Planning Commission hearing. 2. City File Number 17-009: Submitted application for a zone change from FD-10 (Future Development- County Zoning) to NC (Neighborhood Community) on Tax Lots 100 & 200 Tax Map 1N2-06DC and Tax Lots 100, 10900, 11800, 12000, 12300 & 12400 Tax Map 1N2-06DD. The application was submitted by Polygon WLH, LLC as represented by Pacific Community Design, Inc. Applicable code sections include: 16.045 (Neighborhood Community), 16.135 (Subdivisions), 16.145 (Public Facility Service Requirements), 16.150 (Street Standards), and 16.160 (Clear Vision Areas). The applicable code section is 16.200 (Comprehensive Plan & Zoning Amendments). Once the Planning Commission has made a recommendation on the proposal, the recommendation will be referred to the City Council for a Monday, May 1, 2017 public hearing, or another date certain as stated at the Planning Commission hearing. 3. City File Number 17-006: Submitted application for a residential subdivision and master plan refinement on Tax Lots 100 & 200 Tax Map 1N2-06DC and Tax Lots 100, 10900, 11800, 12000, 12300 & 12400 Tax Map 1N2-06DD. The application was submitted by Polygon WLH, LLC as represented by Pacific Community Design, Inc. Applicable code sections include: 16.045 (Neighborhood Community), 16.135 (Subdivisions), 16.145 (Public Facility Service Requirements), 16.150 (Street Standards), and 16.160 (Clear Vision Areas). The public hearings will be held at 7:00 p.m. at the North Plains Senior Center, 31450 NW Commercial Street, North Plains, Oregon. Questions and written comments regarding the proposed changes are welcomed and can be directed to City Manager Blake Boyles at blake@northplains.org or by calling (503) 647-5555. All interested persons will be given the opportunity to be heard. Copies of the applications are available for public review at City Hall, 31360 NW Commercial Street, North Plains, Oregon and the City’s website northplains.org. Copies of the Planning Commission staff report will be available after April 5, 2017. Written comments will be received until 5:00 p.m. April 11, 2017 at City Hall and until the final public hearing is closed for each land use action. All evidence relied upon by the City to make this decision is in the public record and available for public review at North Plains City Hall, North Plains, Oregon during regular business hours. Failure to address an issue with enough detail during the comment period or at the public meeting may preclude an appeal to the Land Use Board of Appeals or Appeals or Circuit Court on that issue. Only comments on the applicable criteria are considered relevant evidence. The hearing will be opened for presentation by the city/applicant and then opened to the public. The hearing can be closed or continued at the discretion of the Planning Commission. If the hearing is closed, the Planning Commission has the right to extend the time for additional information to be submitted by the public or the applicant. After the comment period closes, the City shall issue a decision. The decision shall be mailed or e-mailed to anyone who submitted written comments or who is otherwise legally entitled to notice.
