TRUSTEE’S NOTICE OF SALE The Trustee under the terms of the Trust Deed described herein, at the direction of the Beneficiary, hereby elects to sell the property described in the Trust Deed to satisfy the obligations secured thereby. Pursuant to ORS 86.771, the following information is provided: 1. PARTIES: Grantor: Blackstone Investment Properties IV, LLC Trustee: First American Title Insurance Company of Oregon Successor Trustee: Cassie K. Jones Beneficiary: Douglas R. Schultz 2. RECORDING. The Trust Deed was recorded as follows: Date Recorded: April 8, 2011 Recording No.: 2011-026899 Official Records of Washington County, Oregon 3. DESCRIPTION OF PROPERTY: The real property is described as follows: Lot 5, Mount Vernon Village Townhouses, in the City of Beaverton, County of Washington and State of Oregon. Commonly known as 6045 SW Erickson Avenue, Beaverton, OR 97008 4. DEFAULT. Both the Beneficiary and the Trustee have elected to sell the said real property to satisfy the obligations secured by said trust deed and a notice of default has been recorded pursuant to Oregon Revised Statutes 86.752(3); the default for which the foreclosure is made is grantor’s failure to pay when due the following sums: all current and past due payments due and payable as of January 19, 2017 in the amount of $83,499.42, plus additional future payments incurred after January 19, 2017; plus related interest, penalties and costs thereto; plus costs, trustees fees, attorneys fees and accruing interest incurred herein by reason of said default; and any further sums advanced by beneficiary for the protection of the above-described real property and his interest therein. 5. AMOUNT DUE. By reason of said default the beneficiary has declared all sums owing on the obligation secured by said trust deed immediately due and payable, said sums being the following, to wit: principal amount of $70,000.00 together with interest through January 19, 2017 of $4,660.06 and continuing at $21.10/day until paid; together with costs, trustees fees, attorneys fees and accruing late charges and interest incurred herein by reason of said default; and any further sums advanced by beneficiary for the protection of the above-described real property and his interest therein; plus any real property taxes or liens incurred. 6. ELECTION TO SELL. The Trustee hereby elects to sell the property to satisfy the obligations secured by the Trust Deed. A Trustee’s Notice of Default and Election to Sell has been recorded in the official records of Washington County, Oregon. 7. TIME OF SALE. Date: June 13, 2017 Time: 11:00 a.m. Place: Washington County Courthouse, 145 NE 2nd Avenue, Hillsboro, OR 97124 in the City of Hillsboro, County of Washington, State of Oregon The Trustee will sell at public auction to the highest bidder for cash the interest in the said described real property which the grantor had or had power to convey at the time of the execution by grantor of the said trust deed, together with any interest which the grantor or grantor’s successors in interest acquired after the execution of said trust deed, to satisfy the foregoing obligations thereby secured and the costs and expenses of sale, including a reasonable charge by the trustee. 8. RIGHT TO REINSTATE. Notice is further given that any person named in ORS 86.778 has the right, at any time prior to five days before the date last set for the sale, to have this foreclosure proceeding dismissed and the trust deed reinstated by payment to the beneficiary of the entire amount then due (other than such portion of the principal as would not then be due had no default occurred) and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation or trust deed, and in addition to paying said sums or tendering the performance necessary to cure the default, by paying all costs and expenses actually incurred in enforcing the obligation and trust deed, together with trustee’s and attorney’s fees not exceeding the amounts provided by said ORS 86.778. In construing this notice, the singular includes the plural, the word grantor includes any successor in interest to the grantor as well as any other person owing an obligation, the performance of which is secured by said trust deed, and the words trustee and beneficiary include their respective successors in interest, if any.
