NOTICE OF PUBLIC HEARING City of Happy Valley Hearings Officer Notice is hereby given that the City of Happy Valley Hearings Officer will hold a public hearing on the following date in regard to the application described herein: Date & Time: Thursday. June 1, 2017 at 9:00 a.m. Hearing Location: City Hall, 16000 SE Misty Drive, Happy Valley, OR 97086 File & Subject: File No. DR-01-17 (47-bed Residential Care Facility) Proposal: Major Design Review of a 47-bed residential care facility, a 15-stall parking lot, drive aisle/maneuvering area, and associated landscaped/hardscaped areas. Location: An approximately one-acre lot located north of Sieben Park Way and west of 147th Avenue; and also described as Clackamas County Assessor Map Number: 22E01C: Tax Lot 306. Applicant: Edward Radelescu Applicable Criteria: Title 16 (Development Code) of the City of Happy Valley Municipal Code, including Chapters 16.23, 16.41, 16.42, 16.43, 16.44, 16.50, 16.61 and 16.62. The decision on the Design Review of the fleet and logistics facility by the Hearings Officer will be made in accordance with said criteria. Failure to raise an issue in writing prior to or before the close of the written comment period, Friday, April 21, 2017 by 5:00 p.m. or failure to provide sufficient specificity at the public hearing to afford the Hearings Officer an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based upon that issue. The applicant and any person who submits written comments shall receive notice of the decision. The failure of the applicant to raise constitutional or other issues relating to proposed conditions of approval with sufficient specificity to allow the Hearings Officer to respond to the issue precludes an action for damages in circuit court.
