IN THE CIRCUIT COURT OF THE STATE OF OREGON FOR THE COUNTY OF MULTNOMAH Case No. 17CV18006 ORS 33.710 NOTICE BY PUBLICATION TO: Multnomah County, a home rule county, and All Electors, Freeholders, Taxpayers and Other Interested Persons. In the Matter of: Validation Proceeding to Determine the Regularity and Legality of Multnomah County Home Rule Charter Section 11.60 and Implementing Ordinance No. 1243 Regulating Campaign Finance and Disclosure. Pursuant to ORS 33.710 and 33.720, the above described validation proceeding was initiated in Multnomah County Circuit Court to determine the regularity and legality, including the constitutionality, of Multnomah County Home Rule Charter Section 11.60 and implementing Ordinance No. 1243, which regulate campaign finance and disclosure in candidate elections for Multnomah County offices. Charter Section 11.60 was passed by Multnomah County voters at the general election held on November 8, 2016 (Measure 26-184), and Ordinance No. 1243 implementing that measure was enacted by the Board of County Commissioners on April 6, 2017. Charter Section 11.60 and Ordinance No. 1243 take effect by their terms on September 1, 2017. The County seeks to have proceedings tried forthwith and judgment of the Court pursuant to ORS 33.710 and 33.720 rendered expeditiously declaring that every subdivision of Charter Section 11.60 and its implementing Ordinance No. 1243 (1) is constitutional under the Oregon Constitution; (2) is constitutional under the United States Constitution; (3) is otherwise valid under state or federal law; and (4) ordering other relief as the court deems just and equitable. The complaint is available for review in the office of the Clerk of the Court or from the undersigned at the address shown below. Any interested person may, at any time before the expiration of the ten (10) day period after final publication of the Notice, appear and contest the validity of these proceedings or the regularity, legality, validity and effect of Charter Section 11.60 and Ordinance No. 1243 by the filing of an answer to the Petition with the Trial Court Clerk, Multnomah County Courthouse, 1021 SW Fourth Avenue, Portland, Oregon, 97204, in the form required by law.
