NOTICE OF PUBLIC HEARING City of Happy Valley Design Review Board Notice is hereby given that the City of Happy Valley Design Review Board will hold a public hearing on the following date in regard to the application described herein: Date & Time: Wednesday, August 30, 2017 at 7:00 p.m. Hearing Location: City Hall, 16000 SE Misty Drive, Happy Valley, OR 97086 File & Subject: File No. DR-09-17 (104-Bed Residential Care Facility) Proposal: Major Design Review of a 104-bed residential care facility, a 54-stall parking lot, drive aisle/ maneuvering area, and associated landscaped/ hardscaped areas. Location: An approximately 2.07-acre lot located at 14330 SE Sunnyside Road, south of Sunnyside Road and north of the intersection of Princeton Village Way and 144th Avenue. The subject property is further described as Clackamas County Assessor Map No. 22E01CB: Tax Lot 4600. Applicant: Confluent Development, LLC Applicable Criteria: Title 16 (Development Code) of the City of Happy Valley Municipal Code, including Chapters: 16.23; 16.41; 16.42; 16.43; 16.44; 16.50; 16.61; and 16.62. The decision on the Design Review of the proposed residential care facility by the Design Review Board will be made in accordance with said criteria. Failure to raise an issue in writing prior to or before the close of the written comment period, Wednesday, August 9, 2017 by 5:00 p.m. or failure to provide sufficient specificity at the public hearing to afford the Design Review Board an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based upon that issue. The applicant and any person who submits written comments shall receive notice of the decision. The failure of the applicant to raise constitutional or other issues relating to proposed conditions of approval with sufficient specificity to allow the Design Review Board to respond to the issue precludes an action for damages in circuit court.
