PUBLIC NOTICE On or about September 12, 2017 the City of Beaverton will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Community Development Block Grant (CDBG) funds, for the July 1, 2017- June 30, 2022 Program Years, for the purpose of administering the Housing Rehabilitation program, which performs critical repairs, accessibility adaptation, and weatherization for low-income homeowners and tenants of regulated affordable housing communities, and Affordable Homeownership program providing housing acquisition assistance. The City of Beaverton is requesting the release of approximately $120,000 per year for 5-years of the city’s annual Entitlement amount for the housing rehabilitation program, and approximately $200,000 for Affordable Homeownership. The City of Beaverton hereby announces that it conducted a tiered environmental review for area-wide factors as provided under 24 CFR Part 58 for the aforementioned programs. In the first tier, a broad area-wide statutory review identified laws and authorities has been determined not to be triggered. However, some environmental factors cannot be determined until specific activities and/or properties become known. Once specific site determination has been made, a second tier review will be analyzed for relevant environmental impacts to assure compliance with Historic Preservation, Floodplain, and Toxic Chemicals and Radioactive Materials. Any mitigation measures required to alleviate or minimize adverse impact will be implemented prior to final approval of CDBG funding for individual activities. An Environmental Review Record (ERR) that documents the environmental determinations for this project, and more fully describes the tiered review process cited above, is on file at the City of Beaverton’s Community Development Department, on the fourth floor of the address listed above, and may be examined or copied weekdays 8:00 a.m. to 5:00 p.m. from Friday, August 25, 2017 to Tuesday, September 12, 2017. Documents are also available for review in PDF format on: www.beavertonoregon.gov/307 PUBLIC COMMENTS: Any individual, group, or agency may submit written comments on the ERR to the City of Beaverton CDBG Staff at City Hall or by email to edeppa@beavertonoregon.gov. All comments received by Friday, September 12, 2017 at 5:00pm will be considered by City of Beaverton prior to authorizing submission of a Request for Release of Funds and Environmental Certification to HUD. RELEASE OF FUNDS: The City of Beaverton certifies to HUD that Denny Doyle in his official capacity as Mayor, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City of Beaverton to utilize federal funds and implement the Program. OBJECTIONS TO RELEASE OF FUNDS: HUD will consider objections to its release of funds and the City of Beaverton certification for a period of fifteen days following either the anticipated submission date (cited above) or HUD’s actual receipt of the request (whichever is later) only if the objections are on one of the following bases: (a) that the Certification was not executed by the Certifying Officer of the City of Beaverton; (b) the City of Beaverton has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the City of Beaverton has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
