NOTICE OF PUBLIC HEARING City of Happy Valley Planning Commission and City Council Notice is hereby given that the City of Happy Valley Planning Commission and City Council will hold public hearings on the following dates regarding the application described herein: Date & Time: Planning Commission, January 9, 2018 at 7:00 p.m. City Council, February 6, 2018 at 7:00 p.m. Hearing Location: City Hall, 16000 SE Misty Dr. Happy Valley, OR 97086 Local File No.: CPA-07-17/LDC-10-17/LP-03-17/ERP-08-17 Proposal: A Comprehensive Plan/Zoning Map Amendment, Two-Parcel Partition and Environmental Review Permit for natural resources on a 14.38-acre split- zoned parcel described as Clackamas County Assessor Map Number 22E10: Tax Lot 700 and located approximately 1,950 feet northeast of the intersection of Minuteman Way and Mather Road, on the east side of Mather Road. The site currently contains 12.54 acres of Residential – Twenty Thousand (20,000) Square Feet (R-20) and 1.84 acres of Industrial Campus (IC) zoning. The appli- cant has proposed to reduce the R-20 zoning to 10.65 acres (proposed Parcel 2) and increase the IC zoning to 3.73 acres (proposed Parcel 1). The attached exhibit depicts the location and existing/ proposed zoning of the subject site as well as a conceptual development plan. Design Review for buildings and improvements on the subject proper- ty would be submitted via separate land use appli- cation(s). It is located approximately 680 feet south of the intersection of 97th Avenue and Mather Road, on the east side of Mather Road. Written testimony may be submitted in advance or in person at the hearings. The decision will be made in accordance with said criteria and may be appealed to the Land Use Board of Appeals. Failure to raise an issue in writing prior to or before the close of the written comment period or failure to provide sufficient specificity at the public hearings to afford the decision-making body an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based upon that issue. The applicant and any person who submits written comments shall receive notice of the decision. The failure of the applicant to raise constitutional or other issues relating to proposed amendments without sufficient specificity to allow the decision-making body to respond to the issue precludes an action for damages in circuit court.
