NOTICE OF PUBLIC HEARING City of Happy Valley Hearings Officer Notice is hereby given that the City of Happy Valley Hearings Officer will hold a public hearing on the following date regarding the proposed 39-Lot Planned Unit Development, Variance and Environmental Review Permit. Date & Time: Hearings Officer – Thursday, May 10, 2018 at 9:00 a.m. Hearing Location: City Hall, 16000 SE Misty Drive, Happy Valley, OR 97086; File & Subject: File No. PUD-02-18/ERP-06-18/VAR-02-18: Pacific Crest Proposal: Planned Unit Development (PUD) / Environmental Review Permit (ERP) / Variance (VAR) to allow development of a 39-lot PUD on approximately 8.27 acres, Environmental Review Permit due to the presence of mapped natural resources and Class B Variance to the minimum required open space area. Written testimony may be submitted in advance or in person at the hearing. The final decision by the Hearings Officer will be made in accordance with said criteria. Failure to raise an issue in writing prior to or before the close of the written comment period, Friday, March 30, 2018 by 5:00 p.m. or failure to provide sufficient specificity at the public hearing to afford the Hearings Officer an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based upon that issue. The applicant and any person who submits written comments shall receive notice of the decision. The failure of the applicant to raise constitutional or other issues relating to proposed conditions of approval with sufficient specificity to allow the Hearings Officer to respond to the issue precludes an action for damages in circuit court.
