ORS 33.710 NOTICE BY PUBLICATION

IN THE CIRCUIT COURT OF THE STATE OF OREGON FOR THE COUNTY OF MULTNOMAH Case No. 19CV06544 ORS 33.710 NOTICE BY PUBLICATION TO: City of Portland, and All Electors, Freeholders, Taxpayers and Other Interested Persons. In the Matter of: Validation Proceeding to Determine the Legality of City of Portland Charter Chapter 3, Article 3 and Portland City Code Chapter 2.10 Regulating Campaign Finance and Disclosure. Pursuant to ORS 33.710 and 33.720, the above described validation proceeding was initiated in Multnomah County Circuit Court to determine the legality, including the constitutionality, of City of Portland Charter Chapter 3, Article 3 and Portland City Code Chapter 2.10 which regulate campaign finance and disclosure in candidate elections for City of Portland offices. Portland City Charter Chapter 3, Article 3, was passed by City of Portland voters in the general election held on November 6, 2018 (Measure 26-200), and Ordinance No. 189348 implementing that measure and adopting Portland City Code Chapter 2.10 was adopted by Portland City Council on January 16, 2019. Portland City Charter Chapter 3, Article 3 and Portland City Code Chapter 2.10 take effect by their terms on September 1, 2019. The City seeks an expeditious judgment of the Court pursuant to ORS 33.710 and 33.720 declaring that every subdivision of Charter Chapter 3, Article 3 and Portland City Code Chapter 2.10 (1) is constitutional under the Oregon Constitution; (2) is constitutional under the United States Constitution; and (3) is otherwise valid under state or federal law. The City further seeks any other relief that the Court deems just and equitable. The petition is available for review in the office of the Clerk of the Court or from the undersigned at the address shown below. Any interested person may, at any time before the expiration of the ten (10) day period after final publication of this Notice, appear and contest the validity of these proceedings or the legality, validity and effect of Portland City Charter Chapter 3, Article 3 or Portland City Code Chapter 2.10 by the filing of an answer to the Petition with the Trial Court Clerk, Multnomah County Courthouse, 1021 SW Fourth Avenue, Portland, Oregon, 97204, in the form required by law.
