SUMMARY STATEMENT FOR RELIEF The relief sought in the Complaint is for Account, Foreclosure of a Construction Lien and Quantum Meruit, relating to labor, equipment or materials provided by Plaintiff, to Defendants, on credit. No portion of this amount owing has been paid. On its first claim for relief, Plaintiff seeks the sum of $17,523.66 plus interest at the rate of 18% per annum from June 12, 2018 until paid; On Plaintiff’s second claim for relief, Plaintiff seeks the sum of $6,457.41, together with interest at 9% per annum from June 12, 2018 until paid; On its third claim for relief, Plaintiff seeks the sum of $17,523.66 plus interest at the rate of 18% per annum from June 12, 2018 until paid. Plaintiff seeks a judgment foreclosing forever, any and all right, title, and interest, legal and equitable, of all defendants, and all persons claiming by or through them, in the Property, described as a certain improvement consisting of a structure located and constructed upon the tract of land legally known as Section 01 Township 5S Range 1E TAX LOT 012000, and commonly known as 11512 S. Barnards Road, Molalla, OR 97038. Plaintiff requests the Sheriff of Clackamas County, Oregon to sell all interest in the Property in the manner provided by law as an execution to satisfy the above sums; and permitting Plaintiff to purchase at the sale; and directing that the proceeds of the sale be applied as follows: (1) To the payment of the costs of the sale; (2) To the payment of the above sums owed to Plaintiff; and (3) The balance, if any, to the Clerk of the Court for application as provided by law. Directing that if the proceeds of the sale are insufficient to satisfy the judgment of Plaintiff, then any such deficiency may be enforced by execution against Defendants; and directing the execution and order of execution issue to enforce this decree; and for such other relief as the court may deem just and proper.
