AMENDED TRUSTEE’S NOTICE OF SALE The Trustee under the terms of the Trust Deed described herein, at the direction of the Beneficiary, hereby elects to sell the property described in the Trust Deed to satisfy the obligations secured thereby. Pursuant to ORS 86.771, the following information is provided: 1. PARTIES: Grantor: MILTON ROBERT KERNS, ACQUIRING TITLE AS MILTON R. KERNS AND MARY LOUISE KERNS, AQUIRING TITLE AS MARY L. DESCRIPTION OF PROPERTY: The real property is described as follows: A tract in Section 24, Township 5 South, Range 2 East, of the Willamette Meridian, in the County of Clackamas and State of Oregon, described as follows: Beginning at a point in the North boundary line of the Clifton R. Callahan and wife Donation Land Claim, South 65deg. 30′ West 16.20 chains (1069.2 feet) from the angular corner on the North line of said claim; thence South 19deg. East 22.091 chains (1458.006 feet); thence North 42deg. 05′ West 23.083 chains (1523.478 feet) to the Northerly line of said claim; thence North 65deg. 32′ East 9.091 chains (600.006 feet) along said Northerly line to the point of beginning. (TRUST DEED ONE) 3. RECORDING. The Trust Deed was recorded as follows: Date Recorded: December 27, 2007 Recording No. 2007-107211 Official Records of Clackamas County, Oregon 4. DEFAULT. The Grantor or any other person obligated on the Trust Deed and Promissory Note secured thereby is in default and the Beneficiary seeks to foreclose the Trust Deed for failure to pay: Monthly payments in the amount of $1,802.03 each, due the first of each month, for the months of July 2018 through November 2018; plus late charges and advances; plus any unpaid real property taxes or liens, plus interest. 5. AMOUNT DUE. The amount due on the Note which is secured by the Trust Deed referred to herein is: Principal balance in the amount of $388,913.70; plus interest at the rate of 4.5% per annum from June 1, 2018; plus late charges of $338.61; plus advances and foreclosure attorney fees and costs. (TRUST DEED TWO): 6. RECORDING. The Trust Deed was recorded as follows: Date Recorded: April 14, 2009 Recording No. 2009-025125 Official Records of Clackamas County, Oregon 7. DEFAULT. The Grantor or any other person obligated on the Trust Deed and Promissory Note secured thereby is in default and the Beneficiary seeks to foreclose the Trust Deed for failure to pay: A monthly payment of $95.27, due July 25, 2018; plus a monthly payment of $103.42, due August 25, 2018; plus a monthly payment of $103.65, due September 25, 2018; plus a monthly payment of $100.73, due October 25, 2018; plus late charges and advances; plus any unpaid real property taxes or liens, plus interest. 8. AMOUNT DUE. The amount due on the Note which is secured by the Trust Deed referred to herein is: Principal balance in the amount of $24,612.75; plus interest at the rate of 5.25% per annum from June 25, 2018; plus late charges of $100.00; plus advances and foreclosure attorney fees and costs. 9. SALE OF PROPERTY. The Trustee hereby states that the property will be sold to satisfy the obligations secured by the Trust Deed. A Trustee’s Notice of Default and Election to Sell Under Terms of Trust Deed has been recorded in the Official Records of Clackamas County, Oregon. 10. TIME OF SALE. Date: April 11, 2019 Time: 11:00 a.m, Place: Clackamas County Courthouse, 807 Main Street, Oregon City, Oregon 11. RIGHT TO REINSTATE. Any person named in ORS 86.778 has the right, at any time that is not later than five days before the Trustee conducts the sale, to have this foreclosure dismissed and the Trust Deed reinstated by payment to the Beneficiary of the entire amount then due, other than such portion of the principal as would not then be due had no default occurred, by curing any other default that is capable of being cured by tendering the performance required under the obligation or Trust Deed and by paying all costs and expenses actually incurred in enforcing the obligation and Trust Deed, together with the trustee’s and attorney’s fees not exceeding the amount provided in ORS 86.778. ___________________________________________________________ NOTICE REGARDING POTENTIAL HAZARDS (This notice is required for notices of sale sent on or after January 1, 2015.)
