CLACKAMAS COUNTY JENNINGS LODGE PEDESTRIAN IMPROVEMENTS PROJECT Bids due: April 3, 2019 @ 2:00 pm INVITATION TO BID Clackamas County, through its Community Development Division, Steve Kelly (503-650-5665) at Stevekel@co.clackamas.or.us for a Planholder List), will receive sealed bids for the JENNINGS LODGE PEDESTRIAN IMPROVEMENTS PROJECT (Milwaukie, OR) until 2:00 pm on Wednesday, April 3, 2019. No bids will be received or considered after that time. Bids will be publicly opened and read immediately after the bid closing time. A list of major subcontractors (i.e. First Tier List) supplying labor or materials must be submitted within two hours of the bid deadline (4PM) as set forth in the instructions to bidders. The project consists of: Construct 970 feet of pedestrian improvements adjacent to the west side of Candy Lane Elementary School on SE Portland Avenue between SE Hull Avenue and SE Jennings Avenue. The improvements will be: a multi-use pathway with new signage, new curb and sidewalk with new and updated signage, stormwater and intersection paving improvements, sidewalk ramps that comply with Americans with Disabilities Act (ADA) standards. Project Estimate Range: $200,000 to $210,000 dollars. Project Classifications: Earthwork And Drainage, Aggregate Bases, Asphalt Paving And Oiling, Cement Concrete Paving, Pavement Markings, Signing, and Landscaping. Time of Construction: Notice to Proceed to Substantial Completion will be 95 days. Important Notes: There are two Contract Times on this Project, see the following: (1) The Contractor shall complete all Work to be done under the Street Construction Improvements- Contract except for seeding, planting, seeding establishment and plant establishment, not later than Monday, August 19, 2019. This is the end of 95 days (Substantial Completion. (2) The Contractor shall complete all Work to be done under the Planting Portion-Contract for seeding establishment and plant establishment, not later than September 30, 2019. This project is financed through the Community Development Block Grant Program with funds obtained from the U.S. Department of Housing and Urban Development. The Contract will be subject to regulations of the Oregon Bureau of Labor and Industries (BOLI) and the federal Department of Labor (DOL) and Department of Housing and Urban Development (HUD). This is a public works contract subject to ORS 279C.800 through 279C.870 and the federal prevailing wage rate as required under the Davis-Bacon Act (40 U.S.C.276a). The successful Bidder will be required to comply with the provisions of section 3 of the Housing and Urban Development Act of 1968 as amended (herein referred to as section 3 requirements). Such provisions require that economic opportunities generated by HUD financial assistance shall, to the greatest extent feasible, be given to low income residents of the metropolitan area in which the project is located and to businesses that provide economic opportunities for these persons. Bids exceeding $100,000 must include an indication of whether or not the firm submitting the bid is a section 3 business concern. The Contractor shall commence no work under this contract until the Contractor and every subcontractor has a public works bond filed with the Construction Board in accordance with ORS 279C.830 and all other bonding and insurance requirements have been met and a Notice to Proceed has been issued. This project is estimated above $100,000 dollars and will qualify as a HUD Section 3 covered contract. This desired designation means: Contracts exceeding $100,000 are considered Section 3 covered contracts and are thus subject to the provisions contained in 15.18 of the General Conditions of the Project Manual. Bids exceeding $100,000 must include an indication of whether or not the firm submitting the bid is a section 3 business concern. A Section 3 business concern is defined by HUD regulations as a business concern: (1) That is 51 percent or more owned by Section 3 residents; or (2) Whose permanent, full-time employees include persons, at least 30 percent of whom are currently section 3 residents or, within three years of the date of first employment with the business concern, were Section 3 residents; or (3) That provides evidence of a commitment to subcontract in excess of 25 percent of the dollar award of all subcontracts to be awarded to business concerns that meet the qualifications set forth in paragraphs (1) or (2) above. A section 3 resident means: (1) A public housing resident; or (2) An individual who resides in the metropolitan area in which the section 3 covered assistance is expended, and who is a low-income person or a very low-income person. For purposes of this project residents of the Portland/Vancouver metropolitan area who are members of families meeting the following income limits are considered low or very low income persons. Only bidders prequalified with Clackamas County for classes of work described in the bid documents will be accepted. Applications are available at the County Purchasing office at 503-742-5444. Bidders may submit applications for prequalification with Clackamas County up to the date and time of the bid opening. Each bid must contain a statement as to whether the bidder is a resident bidder, as defined in ORS 279A.120. Clackamas County may reject any bid not in compliance with all prescribed public bidding procedures and requirements, and may reject for good cause any or all bids upon a finding of the County that it is in the public interest to do so.
