Jonas to Yamhill County for road purposes by Deed recorded August 4, 1914 in Book 68, Page 147, Deed Records. Also excepting therefrom that portion of the above described tract lying between the East line of County Road No. 284 and the West Section line of Section 16, Township 4 South, Range 5 West of the Willamette Meridian in Yamhill County, Oregon. The Beneficiary and the Trustee have elected to sell the real property to satisfy the obligations secured by the Trust Deed and a notice of default has been recorded pursuant to ORS 86.752(3); the default for which the foreclosure is made is Grantors’ failure to pay when due the monthly installments in the amount of $10,000.00 each, for the months of November, 2019, December 2019 and January 2020, according to the terms of promissory note, secured by the Trust Deed described above, namely: $30,000.00 Monthly installments; $569.00 Attorney Fees as of January 1, 2020, $1,500.00 Title reports; $32,069.00 TOTAL PAST DUE as of January 1, 2020. By power given the Beneficiary under the Trust Deed, Beneficiary herewith declares all sums due under the Trust Deed to be immediately due, owing, and payable without further demand. The true amount due and owing the Beneficiary by the Grantor herein, is as follows: $100,000.00 Principal; $569.00 Attorney Fees as of 01/012020, $1,500.00 Title reports $444,238.67 Interest through 01/01/2020; $546,307.67 Balance due on Trust Deed as 01/01/2020, plus interest accruing thereafter at the rate of 20% compounded monthly, until paid in full, plus the cost of attorney’s fees, and trustee’s fees; together with any other sums due or that may become due under the Note or by reason of the default, this foreclosure and any further advances made by Beneficiary as allowed by the Note and Deed of Trust. Notice is hereby given that the undersigned will on Tuesday, June 16, 2020, at 9:00 o’clock a.m., Pacific Time, on the front steps of the Yamhill County Courthouse, 535 NE 5th St, McMinnville, Oregon, sell at public auction to the highest bidder for cash the interest in the said described real property which the Grantors had or had power to convey at the time of the execution by them of the Trust Deed, to satisfy the foregoing obligations thereby secured and the costs and expenses of sale, including a reasonable charge by the trustee. Notice is further given that any person named in ORS 86.778 has the right to have the foreclosure proceeding dismissed and the Trust Deed reinstated by payment of the entire amount due (other than such portion of said principal as would not then be due had not default occurred), together with costs, trustee’s and attorney’s fees as provided by ORS 86.778, and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation of the Trust Deed at any time prior that is not later than five (5) days before the date set for said sale. Without limiting the trustee’s disclaimer of representations or warranties, Oregon law requires the trustee to state in this notice that some residential property sold at a trustee’s sale may have been used in manufacturing methamphetamines, the chemical components of which are known to be toxic. Prospective purchasers of residential property should be aware of this potential danger before deciding to place a bid for this property at the trustee’s sale.
