CITY OF MOLALLA
NOTICE OF BALLOT TITLE
FOR THE NOVEMBER 8, 2016
NOTICE IS HEREBY GIVEN that on July 13, 2016 the City Recorder received from the City Attorney the following ballot title for a measure to be referred to the legal voters of the City of Molalla:
CAPTION: Authorizing tax on recreational retail sales of marijuana items.
QUESTION: Shall Molalla impose a three percent tax on the sale of marijuana items by a marijuana retailer?
SUMMARY: Under a state law, cities in Oregon may adopt ordinances imposing up to a three percent tax or fee on the sale of recreational marijuana items in the city by state-licensed marijuana retailers as long as the ordinance is referred to the voters for approval at the next statewide general election. This measure seeks the required voter approval for a three percent tax on recreational marijuana sold in the city by state-licensed marijuana retailers.
If this measure is approved, the City would be authorized to impose a three percent tax on recreational marijuana sales in Molalla.
NOTICE IS FURTHER GIVEN that any elector of the City who believes the proposed measure contains more than one subject or who believes the ballot title is insufficient, not concise, or unfair may file a petition for judicial review with the Circuit Court for Clackamas County no later than 5:00 PM on July 28, 2016, which is at least seven business days after this notice.
Any elector who files a petition to review the ballot title must notify the City Recorder in writing that the petition has been filed no later than 5:00 PM on the next business day following the day the petition is filed.
