TRUSTEE’S NOTICE OF SALE Reference is made to that certain Deed of Trust (hereafter referred to as the Trust Deed) made by: Michael J. Jackson and Teresa Jackson, as the Grantor, Ticor Title, as the Trustee, Kenneth W. Ward and Londa K. Ward, husband and wife, as the Beneficiary, recorded August 25, 2010, as Doc. No. 2010-007000, in the Mortgage Records of Columbia County, Oregon, covering the following described real property situated in said county and state, to wit: A portion of tract of land as described in Deed Book 200, page 939, Deed Records of Columbia County, Oregon, lying in the Northeast quarter of the Southwest quarter of Section 11, Township 3 North, Range 2 West of the Willamette Meridian, Columbia County, Oregon, being more particularly described as follows: Beginning at the Northwest corner of the Northeast quarter of the Southwest quarter of said Section 11; thence South 120′ West 868.82 feet; thence South 8914′ East, a distance of 140.09 feet; thence North 120′ East a distance of 415.74 feet; thence North 6523′ East, a distance of 261.24 feet; thence North 2153’53 East 335.72 feet to a 5/8 inch iron rod with a yellow plastic cap marked K.L.S. Surveying Inc. on the Southerly right of way line of J.P. West County Road No. P-131; thence continuing North 2153’53 East to the centerline of said County Road; thence Northwesterly along said centerline of County Road to the intersection with the North line of the Northeast quarter of the Southwest quarter of said Section 11; thence North 8914′ West along said North line 501.90 feet, more or less, to the point of beginning. EXCEPTING THEREFROM the rights of the public to that portion lying within the County Road. The Tax Assessor’s Account ID for the Real Property is purported to be: 5626 ; Map Number: 3N2W11-00-00801 Both the beneficiary and the trustee, Sia Rezvani, have elected to foreclose the above referenced Trust Deed and sell the said real property to satisfy the obligations secured by the Trust Deed and a Notice of Default and Election to Sell has been recorded pursuant to ORS 86.752(3). All right, title, and interest in the said described property which the grantors had, or had power to convey, at the time of execution of the Trust Deed, together with any interest the grantors or their successors in interest acquired after execution of the Trust Deed shall be sold at public auction to the highest bidder for cash to satisfy the obligations secured by the Trust Deed and the expenses of sale, including the compensation of the trustee as provided by law, and the reasonable fees of trustee’s attorneys. The default(s) for which foreclosure is made is (1) the grantor’s failure to make regular payments to the beneficiary, such default beginning May 1, 2015, and continuing through the date of this Notice, and (2) the grantor’s failure to repay the loan in full on October 1, 2015, (3) failure to carry, and/or provide evidence of, extended coverage hazard insurance, in violation of the Trust Deed, and (4) failure to pay county property taxes when due, and (5) any defaults or breaches occurring after the date of this document. The current balance of payments now due, together with late charges, attorney and trustee fees, costs, title expenses, and other allowed charges is $103,915.61* together with any default in the payment of recurring obligations as they become due, periodic adjustments to the payment amount, any further sums advanced by the beneficiary to protect the property or its interest therein, additional costs and attorney fees as provided by law, and prepayment penalties/premiums, if any, together with defaulted amounts owed to senior lienholders.
