TRUSTEE’S NOTICE OF SALE Reference is made to that certain Deed of Trust (hereafter referred to as the Trust Deed) made by: Michael J. Jackson and Teresa Jackson, as the Grantor, Ticor Title, as the Trustee, Kenneth W. Ward and Londa K. Ward, husband and wife, as the Beneficiary, recorded August 25, 2010, as Doc. No. 2010-007000, in the Mortgage Records of Columbia County, Oregon, covering the following described real property situated in said county and state, to wit: A portion of tract of land as described in Deed Book 200, page 939, Deed Records of Columbia County, Oregon, lying in the Northeast quarter of the Southwest quarter of Section 11, Township 3 North, Range 2 West of the Willamette Meridian, Columbia County, Oregon, being more particularly described as follows: Beginning at the Northwest corner of the Northeast quarter of the Southwest quarter of said Section 11; thence South 120′ West 868.82 feet; thence South 8914′ East, a distance of 140.09 feet; thence North 120′ East a distance of 415.74 feet; thence North 6523′ East, a distance of 261.24 feet; thence North 2153’53 East 335.72 feet to a 5/8 inch iron rod with a yellow plastic cap marked K.L.S. Surveying Inc. on the Southerly right of way line of J.P. West County Road No. P-131; thence continuing North 2153’53 East to the centerline of said County Road; thence Northwesterly along said centerline of County Road to the intersection with the North line of the Northeast quarter of the Southwest quarter of said Section 11; thence North 8914′ West along said North line 501.90 feet, more or less, to the point of beginning. EXCEPTING THEREFROM the rights of the public to that portion lying within the County Road. The Tax Assessor’s Account ID for the Real Property is purported to be: 5626 ; Map Number: 3N2W11-00-00801 Both the beneficiary and the trustee, Sia Rezvani, have elected to foreclose the above referenced Trust Deed and sell the said real property to satisfy the obligations secured by the Trust Deed and a Notice of Default and Election to Sell has been recorded pursuant to ORS 86.752(3). All right, title, and interest in the said described property which the grantors had, or had power to convey, at the time of execution of the Trust Deed, together with any interest the grantors or their successors in interest acquired after execution of the Trust Deed shall be sold at public auction to the highest bidder for cash to satisfy the obligations secured by the Trust Deed and the expenses of sale, including the compensation of the trustee as provided by law, and the reasonable fees of trustee’s attorneys. The default(s) for which foreclosure is made is (1) the grantor’s failure to make regular payments to the beneficiary, such default beginning May 1, 2015, and continuing through the date of this Notice, and (2) the grantor’s failure to repay the loan in full on October 1, 2015, (3) failure to carry, and/or provide evidence of, extended coverage hazard insurance, in violation of the Trust Deed, and (4) failure to pay county property taxes when due, and (5) any defaults or breaches occurring after the date of this document. The current balance of payments now due, together with late charges, attorney and trustee fees, costs, title expenses, and other allowed charges is $103,915.61* together with any default in the payment of recurring obligations as they become due, periodic adjustments to the payment amount, any further sums advanced by the beneficiary to protect the property or its interest therein, additional costs and attorney fees as provided by law, and prepayment penalties/premiums, if any, together with defaulted amounts owed to senior lienholders. The amount required to cure the default in payments to date is calculated as follows: Interest from April 27, 2015 through September 9, 2016 @ 5%: $6,307.75. Principal Balance due as of September 9, 2016: $91,909.33. Late charges: $975.00. Escrow items (taxes/insurance,etc.): $1,703.53. Trustee’s/Atty’s Fees and Costs (estimated): $3,020.00. Payment of the Escrow Items listed above may or may not be sufficient to bring insurance and tax obligations current, please coordinate closely with the successor trustee, Sia Rezvani, to determine precisely what amounts will be required to reinstate your obligations under the Trust Deed. By reason of said default the beneficiary has declared all sums owing on the obligation secured by the Trust Deed due and payable. The amount required to discharge this lien in its entirety to date is: $103,915.61* Said sale shall be held at the hour of 11:00 a.m. on January 17, 2017, in accord with the standard of time established by ORS 187.110, and pursuant to ORS 86.771(7) shall occur at the following designated place: AT THE WEST ENTRANCE TO THE COLUMBIA COUNTY COURTHOUSE, 230 THE STRAND, ST. Other than as shown of record, neither the said beneficiary nor the said trustee have any actual notice of any person having or claiming to have any lien upon or interest in the real property hereinabove described subsequent to the interest of the trustee in the Trust Deed, or of any successor(s) in interest to the grantors or of any lessee or other person in possession of or occupying the property, except: N/A. Notice is further given that any person named in ORS 86.753 has the right, at any time prior to five days before the date last set for sale, to have this foreclosure proceeding dismissed and the Trust Deed reinstated by payment to the beneficiary of the entire amount then due (other than such portion of the principal as would not then be due had no default occurred) and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation(s) of the Trust Deed, and in addition to paying said sums or tendering the performance necessary to cure the default, by paying all costs and expenses actually incurred in enforcing the obligation and Trust Deed, together with trustee’s and attorney’s fees not exceeding the amounts provided by ORS 86.753.
