PUBLIC NOTICE NOTICE OF FINDING OF NO SIGNIFICANT IMPACT ON THE ENVIRONMENT and NOTICE OF REQUEST FOR RELEASE of HOME GRANT FUNDS (Program M-16-UC-41-0201) and COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS (B-16-UC-41-0001) February 8, 2017 Clackamas County Community Development Division 2051 Kaen Road, Suite 245 Oregon City, Oregon 97045 (503) 655-8591 REQUEST FOR RELEASE OF FUNDS On or about February 27, 2017 the County of Clackamas will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of CDBG funds under Title I of the Housing and Community Development Act of l974 (PL 93-383) and HOME funds under the National Affordable Housing Act, as amended, for the Northwest Housing Alternatives Annie Ross House Campus Redesign Project. Annie Ross House is one of ten (10) buildings that will be torn down on the Northwest Housing Alternatives (NHA) Campus in Milwaukie, Oregon. Five (5) new buildings containing multi-family housing and office space will be built to replace the existing houses. The five new buildings will add a total of 38 affordable energy efficient housing units including the Annie Ross House Emergency Shelter for families and office space for NHA staff. The NHA campus property is approximately 1.6 acres located at 2316 SE Willard Street in Milwaukie, Oregon. FINDING OF NO SIGNIFICANT IMPACT A Phase I Environmental Site Assessment of the proposed project site was completed on April 5, 2016 by Hahn and Associates, Inc. The Phase I Environmental Assessment found no significant environmental hazards. The County of Clackamas has conducted an Environmental Assessment and determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Community Development offices, 2051 Kaen Road, Suite 245, Oregon City, Oregon and may be examined or copied weekdays 8:30 A.M. to 5:00 P.M. PUBLIC COMMENTS Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the Clackamas County Community Development Division at the above address All comments received by February 24, 2017 will be considered by the County of Clackamas prior to authorizing submission of a request for release of funds. Commentors should specify which part of this Notice they are addressing. RELEASE OF FUNDS The County of Clackamas certifies to HUD that the County of Clackamas and Chuck Robbins, in his capacity as Community Development Director and Certifying Officer, consent to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the County of Clackamas to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and the County of Clackamas certification received by March 17, 2017 or a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer or other officer of the County of Clackamas approved by HUD; (b) the County of Clackamas has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD/State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to HUD CPD, Green-Wyatt Federal Building, 1220 SW 3rd Avenue, Suite 400, Portland, OR 97204-2825. Potential objectors should contact HUD to verify the actual last day of the objection period. This Notice shall satisfy the above-cited two separate but related procedural notification requirements.
