NOTICE OF PUBLIC HEARING FOREST GROVE CITY COUNCIL NOTICE IS HEREBY GIVEN that the Forest Grove City Council on Monday, August 14, 2017, at 7:00 p.m. or thereafter, will meet at the Forest Grove Community Auditorium, 1915 Main Street, to review the following proposal: ITEM: Appeal of the Planning Commission’s interpretation of Development Code 10.12.210(L2)(o) Rear Lot Line File Number: 311-17-000130-DWL Location: 3402 Ivy Crest Court (Washington County tax lot 1N426CA05300) Appellants: Jason and Suzanne Jewett Criteria: Development Code 10.2.500 Director’s Interpretation; and 10.12.210 Meaning of Specific Words and Terms. Background: The appellants are contesting how the rear lot line was determined for a home to be constructed on an adjacent lot. At this time and place all persons will be given a reasonable opportunity to give testimony about this proposal. If an issue is not raised in the hearing (by person or by letter) or if the issue is not explained in sufficient detail to allow the Council to respond to the issue, then that issue cannot be used for an appeal to the Land Use Board of Appeals (LUBA). The City Council hearing shall be limited only to those issues raised before the Planning Commission. The Council will take evidence and hear testimony on the following issues: Did the Community Development Director correctly interpret the definitions in DC 10.12.210(L2) (setbacks) and DC 10.1.120 (interpretation)? Did the City interpret the setback requirement differently in 2010, and if so is that interpretation binding? Issues regarding the fence and proposed retaining wall; City enforcement of Conditions, Covenants and Restrictions; If a variance was requested; The pending lawsuit between the applicant and the appellant; Whether the appellant is using the appeal process to create issues for the applicant; If the proposed construction aesthetically pleasing. If additional documents or evidence are provided in support of the application, any party shall be entitled to a continuance of the hearing. Unless there is a continuance, the record shall remain open for at least seven (7) days after the hearing.
