CITY OF HILLSBORO NOTICE OF PUBLIC HEARING CASE FILE NO.: DW-001-17 HILLSBORO SCHOOL DISTRICT NOTICE IS HEREBY GIVEN that a public hearing will be held before the Hillsboro City Council at or shortly after 7:00 p.m., on Tuesday, September 19, 2017 in the Shirley Huffman Auditorium at the Civic Center, 150 E Main Street, Hillsboro. At this hearing, the City Council will consider withdrawal of a portion of a property from the Tualatin Valley Fire & Rescue service district. This property was annexed into the City in 2012, prior to the amended Urban Service Agreement that the City of Hillsboro signed with Tualatin Valley Fire & Rescue in 2014. The Urban Service Agreement stipulated that the City was to be the provider of fire and rescue services within South Hillsboro, of which the subject site is located within. The subject property can be specifically identified as a portion of Tax Lot 100 on Washington County Assessor’s Tax Map 1S2-10DD. The property is owned by the Hillsboro School District, and the applicant is the City of Hillsboro. The approval criteria for withdrawing property from a service district when that property has been incorporated or annexed into a city are listed in Oregon Revised Statute (ORS) 222.524 and Metro Code Sections 3.09.045 and 3.09.050. The applicable criteria may be viewed online or in the Planning Department office. The staff report on this matter will be available on Friday, September 1, 2017 at 4:00 p.m. The staff report and the applicable criteria are available for public inspection at no cost, or copies can be provided at reasonable cost, from 8:00 a.m. to 5:00 p.m. weekdays, excluding holidays, in the Planning Department at the Civic Center, 150 E. Main Street, 4th floor, Hillsboro, Oregon. All interested persons are invited to attend this meeting and will be given an opportunity to be heard concerning the proposal. Oral testimony will be taken in the following order: applicant; other proponents; opponents; and applicant’s rebuttal. Oral testimony should avoid repetition of issues, and should be based on the application or on the approval criteria listed above. ORS 197.763 provides that under certain circumstances, the record may remain open or a continuance may be granted upon the request of a participant. If you are unable to attend the hearing, you may submit a written statement to the Planning Director at the address shown above, on or before the hearing date. Telephone conversations cannot be accepted as testimony. Please reference the Case File No. on all written testimony. Pursuant to ORS 197.763, failure to raise an issue at the final evidentiary hearing, or by close of the record, in person or by letter, or failure to provide statements or evidence sufficient to afford the decision maker an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based on that issue.
