NOTICE OF PUBLIC HEARING City of Happy Valley City Council NOTICE IS HEREBY GIVEN that the Happy Valley City Council will hold a public hearing to consider the annexation of territory pursuant to Section 16.67.070 of the City’s Land Development Code (LDC) in the City Hall Council Chambers, 16000 Misty Drive, Happy Valley, Oregon on Tuesday, October 17, 2017 at 7:00 p.m. DOCKET NUMBER: ANN-02-17/CPA-05-17/LDC-07-17 The affected area includes 22 tax lots totaling approximately 34.26 acres. 16 of the 22 properties are generally located east of the current City boundary in the western portion of the recently disincorporated City of Damascus; three properties are south of Sunnyside Road between 132nd Avenue and Sierra Drive; one property is located at the southwest corner of Idleman Road and 92nd Avenue; and one property is north of Sunnyside Road and east of 132nd Avenue. The affected area also includes: A 60-foot wide section of right-of-way, known as Foster Road, extending 1850 feet southeast, from the southwestern corner of Clackamas County Assessor Map Number 23E04 01500, to the northeastern corner of Clackamas County Assessor Map Number 23E05D 01700; a section of right-of-way, ranging from 40 feet to 63 feet in width, known as Idleman Road, extending 400 feet west from of the southwest corner of Clackamas County Assessor Map Number 12E28DB02100, to the northeastern corner of Clackamas County Assessor Map Number 12E28CD 00100; a 50-foot wide section of right-of-way, known as 132nd Avenue, extending 200 feet north, from the southeastern corner of Clackamas County Assessor Map Number 22E02AB06516, to the southwestern corner of Clackamas County Assessor Map Number 22E02AB04700; a 50-foot wide section of right-of-way, known as Tumbleweed Court, extending 375 feet southeast, from the southwestern corner of Clackamas County Assessor Map Number 22E02AB04700 to the cul-de-sac terminus of Tumbleweed Court. The City Council intends to decide on the application for annexation of the above property at the public hearing. The Council may approve or deny an application for annexation in accordance with the applicable criteria of the City of Happy Valley Comprehensive Plan; Section 16.67.070 of the LDC; METRO Code Section 3.09; and, ORS 222.111, 222.125 and 222.170. The decision will be made in accordance with the said criteria, and may be appealed to the Land Use Board of Appeals.
