NOTICE OF PUBLIC HEARING HEARING DATE: On November 15, 2017 the City of Oregon City – City Commission will conduct a public hearing at 7:00 PM in the City Hall Commission Chambers at City Hall, 625 Center Street, Oregon City 97045 on the following item. APPLICATION: Land Use Board of Appeals (LUBA) remand of the Historic Nomination for the Community Cannery and Workshop Annex in the Upper Yard of the City’s Public Works Operations Center APPELLANT: McLoughlin Neighborhood Association c/o Jesse A. Buss 411 5th Street Oregon City, OR 97045 OWNER/ APPLICANT: City of Oregon City PO Box 3040 Oregon City, OR 97045 LIMITED ISSUES FOR CONSIDERATION: The City Commission’s review will be limited to the following three issues: (1) Whether the adoption of OCMC 17.40.50 authorizing the Historic Review Board to review historic designations, serve to waive the City’s right to object to a historic designation under ORS 197.772; (2) Who has authority to refuse to consent to a historic designation; and (3) Whether ORS 197.772(1) allows public entities to refuse to consent to a historic designation. The appeal and all documents submitted by or on behalf of the appellant and other parties are available for inspection at no cost at the Oregon City Planning Division, 221 Molalla Avenue, Suite 200, Monday through Friday during regular business hours. The staff report, with all the applicable approval criteria, will also be available for inspection seven days prior to the hearing. Copies of these materials may be obtained for a reasonable cost in advance of the hearing. The City Commission’s decision is the City’s final decision and is appealable to the Land Use Board of Appeals (LUBA) within twenty-one days of when it becomes final by those with standing. The procedures that govern the hearing will be posted at the hearing and are found in OCMC 17.50. The City Commission’s review shall be limited to the three items identified by the Land Use Board of Appeals (LUBA) for remand and as listed above. Further, no new evidence will be allowed. Any persons may participate either orally or in writing in this proceeding, up and until the City Commission closes the record, by providing argument, related to the three issues identified above, and based on evidence located within the existing record. Written comments must be received by the Planning Division by 3:30pm on November 6, 2017 to be included in the staff report. Written comments received after November 6, 2017 will be forwarded to the City Commission for consideration.
